Abu al-Yaman narrated to us, Shu'ayb informed us, from al-Zuhri (upon him be mercy), he said: Urwa bin al-Zubayr (upon him be mercy) used to narrate that he asked Umm al-Mu'minin Hadrat Aisha (may Allah be well pleased with her) about the verse: {And if you fear that you cannot deal justly with the orphans, then marry those women who seem good to you}. She stated: This refers to an orphan girl who is in the guardianship of her guardian, and he desires to marry her because of her beauty and wealth but wishes to give her less dowry than what is customary for women of her status. So they were prohibited from marrying such women unless they give them their full dowry, and they were commanded to marry other women instead. Umm al-Mu'minin Hadrat Aisha (may Allah be well pleased with her) stated: Then the people sought a ruling from the Beloved Messenger of Allah (blessings and peace of Allah be upon him) afterwards, and Allah Almighty revealed the verse: {And they seek your ruling concerning women. Say: Allah gives you His ruling concerning them}. She stated: Allah the Exalted clarified in this verse that when an orphan girl is beautiful and wealthy, they desire to marry her but fall short in the dowry and just treatment; and when she is poor and plain-looking, they turn away from her and marry other women instead. So just as they turn away from her when she is in need, they were likewise prohibited from marrying her unless they deal justly with her and give her full dowry.

ہم سے ابو الیمان نے بیان کیا، ہمیں شعیب نے خبر دی، زہری رحمۃ اللہ تعالیٰ علیہ سے، انہوں نے فرمایا: عروہ بن الزبیر رحمۃ اللہ تعالیٰ علیہ بیان کرتے تھے کہ انہوں نے حضرت اُمّ المؤمنین عائشہ رضی اللہ تعالیٰ عنہا سے (اس آیت کے بارے میں) پوچھا: {وَإِنْ خِفْتُمْ أَنْ لَا تُقْسِطُوا فِي الْيَتَامَى فَانْكِحُوا مَا طَابَ لَكُمْ مِنَ النِّسَاءِ} (اگر تمہیں خوف ہو کہ یتیموں سے انصاف نہ کر سکو گے تو عورتوں میں سے جو تمہیں پسند آئیں نکاح کر لو)۔ انہوں نے فرمایا: یہ اس یتیم لڑکی کے بارے میں ہے جو اپنے ولی کی پرورش میں ہو اور وہ اس کے حسن اور مال کی وجہ سے اس سے نکاح کرنا چاہے لیکن اس کے مہر میں ایسی عورتوں کے مقابلے میں کم دینا چاہے۔ تو انہیں منع کیا گیا کہ ایسی عورتوں سے نکاح کریں مگر یہ کہ مہر پورا ادا کریں، اور حکم دیا گیا کہ ان کے علاوہ دوسری عورتوں سے نکاح کریں۔ حضرت اُمّ المؤمنین عائشہ رضی اللہ تعالیٰ عنہا نے فرمایا: پھر لوگوں نے رسول اللہ صلی اللہ تعالیٰ علیہ وآلہ وسلم سے اس کے بعد فتویٰ پوچھا تو اللہ عزوجل نے یہ آیت نازل فرمائی: {وَيَسْتَفْتُونَكَ فِي النِّسَاءِ قُلِ اللَّهُ يُفْتِيكُمْ فِيهِنَّ} (اور وہ آپ سے عورتوں کے بارے میں فتویٰ پوچھتے ہیں، آپ فرما دیں: اللہ تمہیں ان کے بارے میں فتویٰ دیتا ہے)۔ انہوں نے فرمایا: اللہ تعالیٰ نے اس آیت میں واضح فرمایا کہ یتیم لڑکی جب خوبصورت اور مالدار ہو تو وہ اس سے نکاح کی رغبت رکھتے ہیں لیکن مہر اور انصاف میں کمی کرتے ہیں، اور جب وہ غریب اور بدصورت ہو تو اس سے اعراض کرتے ہیں اور اس کی جگہ دوسری عورتوں سے نکاح کرتے ہیں۔ پس جیسے اس سے اعراض کرتے ہیں جب وہ محتاج ہو، ویسے ہی انہیں اس کے ساتھ نکاح سے منع کیا گیا جب تک کہ انصاف نہ کریں اور اس کا پورا مہر ادا نہ کریں۔
