Isma'il narrated to us, he said: Malik narrated to me, from Ibn Shihab, from 'Ubayd Allah ibn 'Abd Allah ibn 'Utbah ibn Mas'ud, from Hadrat Abu Hurayrah and Hadrat Zayd ibn Khalid (may Allah be well pleased with them both), who informed him that two men brought their dispute to the Beloved Messenger of Allah (blessings and peace of Allah be upon him). One said: Judge between us according to the Book of Allah. The other — who was the more learned of the two — said: Yes, O Beloved Messenger of Allah (blessings and peace of Allah be upon him)! Judge between us according to the Book of Allah, and permit me to speak. He stated: "Speak." He said: My son was a laborer for this man — Malik said: al-'asif means a laborer — and he committed adultery with his wife. People told me that my son deserved stoning, so I ransomed him with a hundred sheep and a slave-girl of mine. Then I asked the people of knowledge, and they informed me that my son deserves a hundred lashes and exile for one year, and that stoning is upon his wife. The Beloved Messenger of Allah (blessings and peace of Allah be upon him) stated: "Hear this! By the One in Whose Hand is my soul, I will certainly judge between you according to the Book of Allah. Your sheep and slave-girl are returned to you." And he had his son given a hundred lashes and exiled for one year. And he ordered Unays al-Aslami to go to the wife of the other man, and if she confessed, to stone her. She confessed, so he stoned her.

ہم سے اسماعیل نے بیان کیا، کہا مجھ سے مالک نے بیان کیا، انہوں نے ابن شہاب سے، انہوں نے عبید اللہ بن عبداللہ بن عتبہ بن مسعود سے، انہوں نے حضرت ابو ہریرہ اور حضرت زید بن خالد رضی اللہ تعالیٰ عنہما سے روایت کیا کہ دو آدمی رسول اللہ صلی اللہ تعالیٰ علیہ وآلہ وسلم کے پاس جھگڑا لے کر آئے۔ ایک نے عرض کیا: ہمارے درمیان اللہ کی کتاب کے مطابق فیصلہ فرمائیے۔ دوسرے نے عرض کیا ـ جو ان دونوں میں زیادہ سمجھدار تھا ـ: ہاں یا رسول اللہ! ہمارے درمیان اللہ کی کتاب کے مطابق فیصلہ فرمائیے اور مجھے بات کرنے کی اجازت دیجیے۔ آپ نے ارشاد فرمایا: "بولو۔" اس نے عرض کیا: میرا بیٹا اس شخص کے یہاں مزدور تھا ـ مالک نے کہا: عسیف کا مطلب مزدور ہے ـ اس نے اس کی بیوی سے زنا کیا۔ لوگوں نے مجھے بتایا کہ میرے بیٹے پر رجم (سنگسار) واجب ہے، تو میں نے سو بکریاں اور ایک لونڈی دے کر اپنے بیٹے کا فدیہ دیا۔ پھر میں نے اہلِ علم سے پوچھا تو انہوں نے بتایا کہ میرے بیٹے پر سو کوڑے اور ایک سال کی جلاوطنی ہے اور رجم اس کی بیوی پر ہے۔ تو رسول اللہ صلی اللہ تعالیٰ علیہ وآلہ وسلم نے ارشاد فرمایا: "سنو! اس ذات کی قسم جس کے ہاتھ میں میری جان ہے! میں تمہارے درمیان اللہ کی کتاب کے مطابق فیصلہ کروں گا۔ تمہاری بکریاں اور لونڈی تمہیں واپس ہیں۔" اور آپ نے اس کے بیٹے کو سو کوڑے لگوائے اور ایک سال کے لیے جلاوطن کیا۔ اور انیس اسلمی کو حکم دیا کہ اس دوسرے شخص کی بیوی کے پاس جائے، اگر وہ اعتراف کر لے تو اسے رجم کر دے، چنانچہ اس نے اعتراف کیا تو اسے رجم کر دیا۔
