وَأَخْبَرَنَا أَبُو زَكَرِيَّا بْنُ أَبِي إِسْحَاقَ الْمُزَكِّي وَأَبُو بَكْرٍ أَحْمَدُ بْنُ الْحَسَنِ الْقَاضِي قَالَا ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ ثنا مُحَمَّدُ بْنُ عَبْدِ اللهِ بْنِ عَبْدِ الْحَكَمِ أنبأ ابْنُ وَهْبٍ أنبأ هِشَامُ بْنُ سَعْدٍ عَنْ زَيْدِ بْنِ أَسْلَمَ عَنْ أَبِيهِ قَالَ سَمِعْتُ عُمَرَ بْنَ الْخَطَّابِ ؓ يَقُولُ لَوْلَا أَنِّي أَتْرُكُ النَّاسَ يَبَابًا لَا شَيْءَ لَهُمْ مَا فُتِحَتْ قَرْيَةٌ إِلَّا قَسَمْتُهَا كَمَا قَسَمَ رَسُولُ اللهِ ﷺ خَيْبَرَ قَالَ الشَّيْخُ وَهَذَا عِنْدَنَا وَاللهُ أَعْلَمُ عَلَى أَنَّهُ كَانَ يَسْتَطِيبُ قُلُوبَهُمْ ثُمَّ يَقِفُهَا لِلْمُسْلِمِينَ نَظَرًا لَهُمْ
English Translation
Abu Zakariyya and Abu Bakr Ahmad ibn al-Hasan the judge informed us from Abu al-Abbas, from Muhammad ibn Abdullah ibn Abd al-Hakam, from Ibn Wahb, from Hisham ibn Sa'd, from Zayd ibn Aslam, from his father who said: I heard Umar ibn al-Khattab (may Allah be pleased with him) say: Were it not that I would leave people destitute with nothing, no village would be conquered except that I would divide it as the Messenger of Allah (peace be upon him) divided Khaybar. The Shaykh said: This, in our view - and Allah knows best - means that he would seek their willing consent and then make it a waqf endowment for the Muslims, acting in their best interest.
