أَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنبأ مُحَمَّدُ بْنُ بَكْرٍ ثنا أَبُو دَاوُدَ ثنا إِبْرَاهِيمُ بْنُ مُوسَى ح قَالَ وَحَدَّثَنَا عَلِيُّ بْنُ بَحْرٍ ثنا عِيسَى هُوَ ابْنُ يُونُسَ الْمَعْنِيُّ عَنْ ثَوْرٍ حَدَّثَنِي أَبُو حُمَيْدٍ الرُّعَيْنِيُّ أَخْبَرَنِي يَزِيدُ ذُو مِصْرَ قَالَ أَتَيْتُ عُتْبَةَ بْنَ عَبْدٍ السُّلَمِيَّ فَقُلْتُ يَا أَبَا الْوَلِيدِ إِنِّي خَرَجْتُ أَلْتَمِسُ الضَّحَايَا فَلَمْ أَجِدْ شَيْئًا يُعْجِبُنِي غَيْرَ ثَرْمَاءَ فَكَرِهْتُهَا فَمَا تَقُولُ؟ قَالَ أَفَلَا جِئْتَنِي بِهَا؟ قُلْتُ سُبْحَانَ اللهِ تَجُوزُ عَنْكَ وَلَا تَجُوزُ عَنِّي؟ قَالَ نَعَمْ إِنَّكَ تَشُكُّ وَلَا أَشُكُّ إِنَّمَا نَهَى رَسُولُ اللهِ ﷺ عَنِ الْمُصْفَرَّةِ وَالْمُسْتَأْصَلَةِ وَالْبَخْقَاءِ وَالْمُشَيَّعَةِ وَالْكَسْرَاءِ فَالْمُصْفَرَّةُ الَّتِي تُسْتَأْصَلُ أُذُنُهَا حَتَّى يَبْدُوَ صِمَاخُهَا وَالْمُسْتَأْصَلَةُ قَرْنُهَا مِنْ أَصْلِهِ وَالْبَخْقَاءُ الَّتِي تُبْخَقُ عَيْنُهَا وَالْمُشَيَّعَةُ الَّتِي لَا تَتْبَعُ الْغَنَمَ عَجَفًا وَضَعْفًا وَالْكَسْرَاءُ الْكَسِيرُ

Abu Ali al-Rudhbari informed us, Muhammad ibn Bakr informed us, Abu Dawud narrated to us, Ibrahim ibn Musa narrated to us. He said: And Ali ibn Bahr narrated to us, Isa - he is Ibn Yunus - narrated to us, meaning from Thawr, Abu Humayd al-Ru'ayni narrated to me, Yazid Dhu Misr informed me, he said: I came to Utbah ibn Abd al-Sulami and said: O Abu al-Walid, I went out seeking sacrificial animals and found nothing that pleased me except a tharmaa' (one with a broken tooth). I disliked it, so what do you say? He said: Why did you not bring it to me? I said: Subhan Allah! Is it acceptable for you but not for me? He said: Yes, because you have doubt and I do not. The Messenger of Allah (peace and blessings be upon him) only prohibited the musfarray (one whose ear is cut to expose the ear canal), the musta'salah (one whose horn is cut from its root), the bakhqa' (one whose eye is gouged out), the mushayya'ah (one that cannot follow the flock due to emaciation and weakness), and the kasra' (the broken one). The musfarray is one whose ear is cut until the ear canal is exposed, the musta'salah is one whose horn is cut from its root, the bakhqa' is one whose eye is gouged, the mushayya'ah is one that cannot follow the flock due to emaciation and weakness, and the kasra' is the broken one.
