أَخْبَرَنَا أَبُو طَاهِرٍ الْفَقِيهُ أنا أَبُو بَكْرٍ الْقَطَّانُ نا إِسْحَاقُ بْنُ عَبْدِ اللهِ بْنِ مُحَمَّدِ بْنِ رَزِينٍ السُّلَمِيُّ نا بِشْرُ بْنُ أَبِي الْأَزْهَرِ نا هُشَيْمٌ عَنْ لَيْثٍ عَنْ مُجَاهِدٍ عَنِ ابْنِ عَبَّاسٍ ؓ قَالَ جَاءَتِ امْرَأَةٌ إِلَى النَّبِيِّ ﷺ فَقَالَتْ يَا رَسُولَ اللهِ مَا حَقُّ الزَّوْجِ عَلَى زَوْجَتِهِ؟ قَالَ أَنْ لَا تَمْنَعَ نَفْسَهَا مِنْهُ وَلَوْ عَلَى قَتَبٍ فَإِذَا فَعَلَتْ كَانَ عَلَيْهَا إِثْمٌ ثُمَّ قَالَتْ مَا حَقُّ الزَّوْجِ عَلَى زَوْجَتِهِ؟ قَالَ أَنْ لَا تُعْطِيَ شَيْئًا مِنْ بَيْتِهِ إِلَّا بِإِذْنِهِ تَفَرَّدَ بِهِ لَيْثُ بْنُ أَبِي سَلَمٍ فَإِنْ كَانَ حَفِظَهُمَا فَوَجْهُ الْحَدِيثِ الثَّابِتِ قَبْلَهُمَا فِي إِبَاحَةِ الْإِنْفَاقِ مِنْ بَيْتِهِ أَنْ تُنْفِقَ مِمَّا أَعْطَاهَا الزَّوْجُ فِي قُوتِهَا وَبِذَلِكَ أَفْتَى أَبُو هُرَيْرَةَ وَاللهُ أَعْلَمُ
الترجمة الإنجليزية
Abu Tahir the jurist informed us... from Ibn Abbas (may Allah be pleased with him), who said: A woman came to the Prophet (peace be upon him) and said: O Messenger of Allah, what is the right of a husband over his wife? He said: That she should not refuse him herself, even on a camel saddle. If she does, she bears the sin. Then she asked: What is the right of a husband over his wife? He said: That she should not give anything from his house without his permission. Laith bin Abi Salim is the sole narrator of this. If he preserved both narrations, then the established hadith before them regarding the permissibility of spending from his house means spending from what the husband has given her for sustenance. Abu Hurairah also gave a fatwa to this effect. And Allah knows best.
