أَخْبَرَنَا أَبُو أَحْمَدَ الْمِهْرَجَانِيُّ أنا أَبُو بَكْرِ بْنُ جَعْفَرٍ ثنا مُحَمَّدُ بْنُ إِبْرَاهِيمَ ثنا ابْنُ بُكَيْرٍ ثنا مَالِكٌ عَنْ رَبِيعَةَ بْنِ أَبِي عَبْدِ الرَّحْمَنِ عَنْ غَيْرِ وَاحِدٍ مِنْ عُلَمَائِهِمْ أَنَّهُ لَمْ يَتَوَارَثْ مَنْ قُتِلَ يَوْمَ الْجَمَلِ وَيَوْمَ صِفِّينَ وَيَوْمَ الْحَرَّةِ ثُمَّ كَانَ يَوْمُ قُدَيْدٍ فَلَمْ يَتَوَارَثْ أَحَدٌ مِمَّنْ قُتِلَ مِنْهُمْ مِنْ صَاحِبِهِ شَيْئًا إِلَّا مَنْ عُلِمَ أَنَّهُ قُتِلَ قَبْلَ صَاحِبِهِ قَالَ مَالِكٌ وَذَلِكَ الْأَمْرُ الَّذِي لَا اخْتِلَافَ فِيهِ عِنْدَنَا وَلَا شَكَّ عِنْدَ أَحَدٍ مِنْ أَهْلِ الْعِلْمِ بِبَلَدِنَا قَالَ الْإِمَامُ أَحْمَدُ رَحِمَهُ اللهُ وَرُوِيَ عَنْ إِيَاسِ بْنِ عَبْدٍ الْمُزَنِيِّ أَنَّهُ قَالَ يُوَرَّثُ بَعْضُهُمْ مِنْ بَعْضٍ وَقَوْلُ الْجَمَاعَةِ أَوْلَى
انگریزی ترجمہ
Abu Ahmad al-Mihrajani informed us: Abu Bakr ibn Ja'far narrated to us: Muhammad ibn Ibrahim narrated to us: Ibn Bukayr narrated to us: Malik narrated from Rabi'ah ibn Abi Abd al-Rahman from more than one of their scholars that those killed on the day of the Camel, the day of Siffin, and the day of al-Harrah did not inherit from each other. Then came the day of Qudayd, and none of those killed inherited from their companion, except for those who were known to have died before their companion. Malik said: This is the practice about which there is no disagreement among us and no doubt among any of the people of knowledge in our land. Imam Ahmad (may Allah have mercy on him) said: It was narrated from Iyas ibn Abd al-Muzani that he said: They should inherit from each other. But the view of the majority is more correct.
