Muhammad ibn Ja'far told us, Shu'bah told us: I heard Abu Ishaq say: I heard a man from the people of Najran say: I asked Ibn Umar, saying, "I only ask you about two things: about selling dates in advance on the palm tree, and about mixing raisins and dates." He said, "The Messenger of Allah, peace and blessings be upon him, was brought a man who was intoxicated, having drunk a mixture of raisins and dates." He said, "So he flogged him with the prescribed punishment and forbade mixing the two." He said, "And a man made an advance-sale contract for the produce of another man's palm trees, but his palm trees did not bear fruit. He said, so he came demanding it, but he refused to give it to him. He said, so the two of them came to the Prophet, peace and blessings be upon him, and he said, 'Did your palm trees bear fruit?' He said, 'No.' He said, 'Then on what basis are you consuming his wealth?'" He said, so he ordered him to return it to him, and he forbade making an advance-sale contract for palm-tree produce until its ripeness becomes apparent.
