حَدَّثَنَا أَبُو دَاوُدَ حَدَّثَنَا هِشَامٌ عَنْ قَتَادَةَ عَنْ خِلَاسٍ عَنْ عَبْدِ اللَّهِ بْنِ عُتْبَةَ قَالَ أَتَى ابْنُ مَسْعُودٍ فِي رَجُلٍ تَزَوَّجَ امْرَأَةً فَمَاتَ عَنْهَا وَلَمْ يَفْرِضْ لَهَا وَلَمْ يَدْخُلْ بِهَا فَسُئِلَ عَنْهَا شَهْرًا فَلَمْ يَقُلْ فِيهَا شَيْئًا ثُمَّ سَأَلُوهُ فَقَالَ أَقُولُ فِيهَا بِرَأْيِي فَإِنْ يَكُ خَطَأً فَمِنِّي وَمِنْ الشَّيْطَانِ وَإِنْ يَكُ صَوَابًا فَمِنْ اللَّهِ لَهَا صَدَقَةُ إِحْدَى نِسَائِهَا وَلَهَا الْمِيرَاثُ وَعَلَيْهَا الْعِدَّةُ فَقَامَ رَجُلٌ مِنْ أَشْجَعَ فَقَالَ أَشْهَدُ لَقَضَيْتَ فِيهَا بِقَضَاءِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي بِرْوَعَ ابْنَةِ وَاشِقٍ قَالَ فَقَالَ هَلُمَّ شَاهِدَاكَ فَشَهِدَ لَهُ الْجَرَّاحُ وَأَبُو سِنَانٍ رَجُلَانِ مِنْ أَشْجَعَ.
انگریزی ترجمہ
Abu Dawud told us: Hisham told us, from Qatada, from Khilas, from Abdullah b. Utba, who said: Ibn Mas'ud was asked about a man who married a woman and died without having fixed a dower for her and without having consummated the marriage. He was asked about it for a month and said nothing about it. Then they asked him again, and he said, "I will give my opinion about it: if it is wrong, it is from me and from Satan; and if it is correct, it is from Allah. She is entitled to a dower like that of women of her status, she has the inheritance, and she must observe the waiting period." Then a man from Ashja' stood up and said, "I testify that you have judged in it with the judgment of the Messenger of Allah, peace and blessings be upon him, regarding Birwa bint Washiq." He said, "Bring your two witnesses." So al-Jarrah and Abu Sinan, two men from Ashja', testified for him.
