حَدَّثَنَا أَبُو سَعِيدٍ حَدَّثَنَا زَائِدَةُ حَدَّثَنَا مَنْصُورٌ عَنْ إِبْرَاهِيمَ عَنْ عُبَيْدِ بْنِ نُضَيْلَةَ عَنْ الْمُغِيرَةِ بْنِ شُعْبَةَ أَنَّ امْرَأَةً ضَرَبَتْهَا امْرَأَةٌ بِعَمُودِ فُسْطَاطٍ فَقَتَلَتْهَا وَهِيَ حُبْلَى فَأُتِيَ بِهَا النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَضَى فِيهَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَلَى عَصَبَةِ الْقَاتِلَةِ بِالدِّيَةِ وَفِي الْجَنِينِ غُرَّةٌ فَقَالَ عَصَبَتُهَا أَنْدِي مَنْ لَا طَعِمَ وَلَا شَرِبَ وَلَا صَاحَ فَاسْتَهَلَّ مِثْلُ ذَلِكَ يُطَلُّ فَقَالَ سَجْعٌ مِثْلُ سَجْعِ الْأَعْرَابِ و قَالَ شُعْبَةُ سَمِعْتُ عُبَيْدًا.
انگریزی ترجمہ
Abu Sa'id told us, Za'idah told us, Mansur told us, from Ibrahim, from Ubayd ibn Nudaylah, from al-Mughirah ibn Shu'bah: A woman struck another woman with a tent pole and killed her while she was pregnant. She was brought before the Prophet, peace and blessings be upon him, and the Messenger of God, peace and blessings be upon him, ruled that the paternal relatives of the killer should pay the blood-money, and for the fetus a ghurrah (a male or female slave). Her relatives said, "Should we pay blood-money for one who neither ate nor drank, nor cried out at birth? Such a case should go unpunished." He said, "That is rhymed speech like the rhymed speech of the bedouin." Shu'bah said: I heard Ubayd.
