Ḥadīth | Ṭabarānī (الطبراني) tabarani:9875 حَدَّثَنَا عَلِيُّ بْنُ سَعِيدٍ الرَّازِيُّ ثنا مُحَمَّدُ بْنُ عُبَيْدٍ الْهَمْدَانِيُّ ثنا الرَّبِيعُ بْنُ زِيَادٍ عَنْ عَمْرِو بْنِ قَيْسٍ الْمُلَائِيِّ عَنْ أَبِي قَيْسٍ الْأَوْدِيِّ عَنْ هُزَيْلِ بْنِ شُرَحْبِيلَ قَالَ أَتَى رَجُلٌ أَبَا مُوسَى وَسَلْمَانَ بْنَ رَبِيعَةَ فَسَأَلَهُمَا عَنْ بِنْتٍ وَبِنْتِ ابْنٍ وَأُخْتٍ لِأَبٍ وَأُمٍّ فَقَالَ لِلِابْنَةِ النِّصْفُ وَلِلْأُخْتِ النِّصْفُ وَقَالَا إِنَّ عَبْدَ اللهِ بْنَ مَسْعُودٍ سَيُتَابِعُنَا فَأَتَيْتُ عَبْدَ اللهِ فَذَكَرْتُ لَهُ قَوْلَهُمَا فَقَالَ لَقَدْ ضَلَلْتُ إِذًا وَمَا أَنَا مِنَ الْمُهْتَدِينَ وَلَكِنْ سَأَقْضِي فِيهَا بِمَا قَضَى فِيهَا النَّبِيُّ ﷺ «لِلِابْنَةِ النِّصْفُ وَلِابْنَةِ الِابْنِ السُّدُسُ تَكْمِلَةَ الثُّلُثَيْنِ وَمَا بَقِيَ فَلِلْأُخْتِ»
English Translation
A man came to Abu Musa and Salman ibn Rabi'ah and asked them about a daughter, a son's daughter, and a full sister. He said: 'The daughter gets half and the sister gets half.' They said: 'Abdullah ibn Mas'ud will agree with us.' So I went to Abdullah and told him their ruling. He said: 'Then I would have gone astray and would not be of the rightly guided. But I will judge in it with what the Prophet (peace be upon him) judged: the daughter gets half, the son's daughter gets one-sixth to complete two-thirds, and the remainder goes to the sister.'
