English Translation
Narrated Malik bin Aws: Umar (may Allah be pleased with him) summoned me, and I came to him when the day had risen, and he was sitting in his house upon a bare bed (without bedding), leaning upon a leather cushion. He said, "O Malik! Some people of your tribe came hurrying to me, and I have had a small amount allotted to them; so distribute it among them all." I said, "I wish you would have someone else do this." He said, "O Malik! You take it." Meanwhile Yarfa (his servant) came and said, "O Commander of the Believers! Uthman bin Affan, Abd ar-Rahman bin Awf, Zubayr, and Sa'd (may Allah be pleased with them) have come; shall I let them in?" Umar (may Allah be pleased with him) said, "Yes, let them in." They came in. Then Yarfa came and said, "Abbas and Ali (may Allah be pleased with them) wish to come in," so Umar (may Allah be pleased with him) said, "Admit them too." Abbas (may Allah be pleased with him) said, "O Commander of the Believers! Decide between me and this liar, sinner, treacherous, thieving one." The people said, "Yes, O Commander of the Believers! Decide between them and relieve them of this matter." Malik bin Aws said: I understood that those two (that is, Ali, may Allah be pleased with him, and Abbas, may Allah be pleased with him) had sent Uthman, Abd ar-Rahman, Zubayr, and Sa'd (may Allah be pleased with them) ahead (so that they might speak to Umar, may Allah be pleased with him, and get the matter decided). Umar (may Allah be pleased with him) said, "Wait! I put you under oath by that Allah by whose command the earth and the heavens stand: do you not know that the Messenger of Allah (peace be upon him) said, 'We prophets leave no inheritance to heirs, and whatever we leave is charity'?" They all said, "Yes, we know." Then he turned to Abbas (may Allah be pleased with him) and Ali (may Allah be pleased with him) and said, "I put you both under oath by that Allah by whose command the earth and the heavens stand: do you know that the Messenger of Allah (peace be upon him) said, 'We prophets have no heir, and whatever we leave is charity'?" They both said, "Indeed, we know." Umar (may Allah be pleased with him) said, "Allah the Exalted singled out a matter for the Messenger of Allah (peace be upon him) that He singled out for no one else. Allah the Exalted said, 'Whatever Allah gave from the property of the townspeople, it is for Allah and the Messenger (peace be upon him)' — I do not know whether he recited the preceding verse or not. Then Umar (may Allah be pleased with him) said, 'The Messenger of Allah (peace be upon him) distributed the property of Banu an-Nadir among you people. And by Allah, he (peace be upon him) did not favor himself over you in it, nor did he take for himself and withhold from you, until this property remained. From it the Messenger of Allah (peace be upon him) would take out his own expenses for one year, and whatever remained was placed in the treasury (Bayt al-Mal).' Then Umar (may Allah be pleased with him) said, 'I put you under oath by that Allah the Exalted by whose command the earth and the heavens stand: do you know all this?' They said, 'Yes, we know.' Then he put Ali (may Allah be pleased with him) and Abbas (may Allah be pleased with him) under a similar oath, and they too said, 'Yes.' Then Umar (may Allah be pleased with him) said, 'When the Messenger of Allah (peace be upon him) passed away, Abu Bakr as-Siddiq (may Allah be pleased with him) said, "I am the guardian of the Messenger of Allah (peace be upon him)," and you two came. Abbas (may Allah be pleased with him) was asking for the estate of his nephew (that is, the Messenger of Allah, peace be upon him, was the son of Abbas's brother), and Ali (may Allah be pleased with him) was seeking his wife's share from her father's property (that is, of Fatimah az-Zahra, may Allah be pleased with her, who was Ali's wife and the daughter of the Messenger of Allah, peace be upon him). Abu Bakr (may Allah be pleased with him) gave this answer, that the noble saying of the Messenger of Allah (peace be upon him) is: "Our property has no heir; whatever we leave is charity." So you regarded him as a liar, sinner, treacherous, and thieving, while Allah the Exalted knows that he was truthful, righteous, guided, and a follower of the truth. Then Abu Bakr (may Allah be pleased with him) passed away, and I am the guardian of the Messenger of Allah (peace be upon him) and of Abu Bakr as-Siddiq (may Allah be pleased with him), so you regarded me too as a liar, sinner, treacherous, and thieving, while Allah the Exalted knows that I am truthful, righteous, upon the truth, and a follower of the truth. I became the guardian of this property too. Then you two came to me, and you two are one, and your affair too is one (that is, though outwardly you are two persons, in respect of the fact that closeness to the Messenger, peace be upon him, is present in both of you, you are like one person). You said, "Hand this property over to us." So I said, "Very well; if you wish, I will give it to you on the condition that you deal with this property just as the Messenger of Allah (peace be upon him) used to deal with it." You took this property from me on that condition.' Then Umar (may Allah be pleased with him) said, 'Is it not so?' They said, 'Yes.' Umar (may Allah be pleased with him) said, 'Then have you two (now) come to me to have it decided? No, by Allah the Exalted! I will make no other decision than this until the Day of Resurrection. But if you cannot manage this property, then return it to me.'" [Mukhtasar Sahih Muslim, Hadith: 1147]
Urdu Translation
سیدنا مالک بن اوس کہتے ہیں کہمجھے سیدنا عمر رضی اللہ عنہ نے بلایا اور میں ان کے پاس دن چڑھے آیا اور وہ اپنے گھر میں (بغیر بستر کے) ننگی چارپائی پر بیٹھے تھے۔ اور ایک چمڑے کے تکیہ پر تکیہ لگائے ہوئے تھے۔ انہوں نے کہا کہ اے مالک! تیری قوم کے کچھ لوگ دوڑ کر میرے پاس آئے تو میں نے ان کو کچھ تھوڑا دلا دیا ہے تو ان سب میں بانٹ دے۔ میں نے کہا کہ کاش یہ کام آپ کسی اور سے لے لیتے۔ انہوں نے کہا کہ اے مالک! تو لے لے۔ اتنے میں یرفا (ان کا خدمتگار) آیا اور کہنے لگا کہ اے امیرالمؤمنین! عثمان بن عفان، عبدالرحمن بن عوف، زبیر اور سعد رضی اللہ عنہا آئے ہیں کیا ان کو آنے دوں۔ سیدنا عمر رضی اللہ عنہ نے کہا کہ اچھا ان کو آنے دے۔ وہ آ گئے۔ پھر یرفا آیا اور کہنے لگا کہ عباس اور علی رضی اللہ عنہا آنا چاہتے ہیں، تو سیدنا عمر رضی اللہ عنہ نے کہا کہ ان کو بھی اجازت دیدے۔ سیدنا عباس رضی اللہ عنہ نے کہا کہ اے امیرالمؤمنین! میرا اور اس جھوٹے، گنہگار، دغاباز اور چور کا فیصلہ کر دیجئیے۔ لوگوں نے کہا کہ ہاں اے امیرالمؤمنین! ان کا فیصلہ کر دیجئیے اور ان کو اس مسئلے سے راحت دیجئیے۔ مالک بن اوس نے کہا کہ میں جانتا ہوں کہ ان دونوں نے (یعنی سیدنا علی رضی اللہ عنہ اور سیدنا عباس رضی اللہ عنہ نے) سیدنا عثمان اور عبدالرحمن اور زبیر اور سعد رضی اللہ عنہا کو (اس لئے) آگے بھیجا تھا (کہ وہ سیدنا عمر رضی اللہ عنہ سے کہہ کر فیصلہ کروا دیں)۔ سیدنا عمر رضی اللہ عنہ نے کہا کہ ٹھہرو! میں تم کو اس اللہ کی قسم دیتا ہوں جس کے حکم سے زمین اور آسمان قائم ہیں، کیا تمہیں معلوم نہیں کہ رسول اللہصلی اللہ علیہ وسلمنے فرمایا ہے کہ ہم پیغمبروں کے مال میں وارثوں کو کچھ نہیں ملتا اور جو ہم چھوڑ جائیں وہ صدقہ ہے؟ سب نے کہا ہاں ہمیں معلوم ہے۔ پھر سیدنا عباس رضی اللہ عنہ اور سیدنا علی رضی اللہ عنہ کی طرف متوجہ ہوئے اور کہا کہ میں تم دونوں کو اس اللہ تعالیٰ کی قسم دیتا ہوں جس کے حکم سے زمین اور آسمان قائم ہیں کیا تم جانتے ہو کہ رسول اللہصلی اللہ علیہ وسلمنے فرمایا ہے کہ ہم پیغمبروں کا کوئی وارث نہیں ہوتا اور جو ہم چھوڑ جائیں وہ صدقہ ہے؟ ان دونوں نے کہا کہ بیشک ہم جانتے ہیں۔ سیدنا عمر رضی اللہ عنہ نے کہا کہ اللہ تعالیٰ نے رسول اللہصلی اللہ علیہ وسلمکے ساتھ ایک بات خاص کی تھی جو اور کسی کے ساتھ خاص نہیں کی۔ اللہ تعالیٰ نے فرمایا کہ”اللہ نے گاؤں والوں کے مال میں سے جو دیا، وہ اللہ اور رسولصلی اللہ علیہ وسلمکا ہی ہے“مجھے معلوم نہیں ہے کہ اس سے پہلے کی آیت بھی انہوں نے پڑھی کہ نہیں پھر سیدنا عمر رضی اللہ عنہ نے کہا کہ رسول اللہصلی اللہ علیہ وسلمنے بنی نضیر کے مال تم لوگوں کو بانٹ دئیے۔ اور اللہ کی قسم آپصلی اللہ علیہ وسلمنے (مال کو) تم سے زیادہ نہیں سمجھا اور نہ یہ کیا کہ آپصلی اللہ علیہ وسلمنے خود لیا ہو اور تمہیں نہ دیا ہو، یہاں تک کہ یہ مال رہ گیا۔ اس میں سے رسول اللہصلی اللہ علیہ وسلمایک سال کا اپنا خرچ نکال لیتے اور جو بچ رہتا، وہ بیت المال میں شریک ہوتا۔ پھر سیدنا عمر رضی اللہ عنہ نے کہا کہ میں تمہیں قسم دیتا ہوں اس اللہ تعالیٰ کی، جس کے حکم سے زمین اور آسمان قائم ہیں کہ تم یہ سب جانتے ہو؟ انہوں نے کہا کہ ہاں! ہم جانتے ہیں۔ پھر سیدنا علی رضی اللہ عنہ اور عباس رضی اللہ عنہ کو بھی ایسی ہی قسم دی، تو انہوں نے بھی یہی کہا کہ ہاں۔ پھر سیدنا عمر رضی اللہ عنہ نے کہا کہ جب رسول اللہصلی اللہ علیہ وسلمکی وفات ہوئی، تو سیدنا ابوبکر صدیق رضی اللہ عنہ نے کہا کہ میں رسول اللہصلی اللہ علیہ وسلمکا ولی ہوں، تو تم دونوں آئے۔ عباس رضی اللہ عنہ تو اپنے بھتیجے کا ترکہ مانگتے تھے (یعنی رسول اللہصلی اللہ علیہ وسلمسیدنا عباس کے بھائی کے بیٹے تھے) اور علی رضی اللہ عنہ اپنی زوجہ مطہرہ کا حصہ ان کے والد کے مال سے چاہتے تھے (یعنی سیدہ فاطمۃالزہراء رضی اللہ عنہا کا جو سیدنا علی رضی اللہ عنہ کی زوجہ تھیں اور رسول اللہصلی اللہ علیہ وسلمکی بیٹی تھیں) سیدنا ابوبکر رضی اللہ عنہ نے یہ جواب دیا کہ رسول اللہصلی اللہ علیہ وسلمکا فرمان ذیشان ہے کہ ہمارے مال کا کوئی وارث نہیں ہوتا جو ہم چھوڑ جائیں وہ صدقہ ہے، تو تم ان کو جھوٹا، گنہگار، دغاباز اور چور سمجھے اور اللہ تعالیٰ جانتا ہے کہ وہ سچے، نیک اور ہدایت پر تھے اور حق کے تابع تھے۔ پھر سیدنا ابوبکر رضی اللہ عنہ کی وفات ہوئی اور میں رسول اللہصلی اللہ علیہ وسلمکا ولی ہوں اور سیدنا ابوبکر صدیق رضی اللہ عنہ کا، تو تم نے مجھے بھی جھوٹا، گنہگار، دغاباز اور چور سمجھا جبکہ اللہ تعالیٰ جانتا ہے کہ میں سچا، نیکوکار اور حق پر ہوں، حق کا تابع ہوں۔ میں اس مال کا بھی ولی رہا۔ پھر تم دونوں میرے پاس آئے اور تم دونوں ایک ہو اور تمہارا معاملہ بھی ایک ہے (یعنی اگرچہ تم ظاہر میں دو شخص ہو مگر اس لحاظ سے کہ قربت رسولصلی اللہ علیہ وسلمدونوں میں موجود ہے تم مثل ایک شخص کے ہو) تم نے یہ کہا کہ یہ مال ہمارے سپرد کر دو تو میں نے کہا کہ اچھا! اگر تم چاہتے ہو تو میں تم کو اس شرط پر دے دیتا ہوں کہ تم اس مال میں وہی کرتے رہو گے جو رسول اللہصلی اللہ علیہ وسلمکیا کرتے تھے۔ تم نے اسی شرط سے یہ مال مجھ سے لیا۔ پھر سیدنا عمر رضی اللہ عنہ نے کہا کہ کیوں ایسا ہی ہے؟ انہوں نے کہا ہاں۔ سیدنا عمر رضی اللہ عنہ نے کہا کہ پھر تم دونوں (اب) میرے پاس فیصلہ کرانے آئے ہو؟ نہیں، اللہ تعالیٰ کی قسم! میں اس کے سوا اور کوئی فیصلہ قیامت تک کرنے والا نہیں، البتہ اگر تم سے اس مال کا بندوبست نہیں ہوتا، تو پھر مجھے لوٹا دو۔[مختصر صحيح مسلم/حدیث: 1147]
