English Translation
Maqil ibn Yasar (may Allah be pleased with him) said, "I had given my sister in marriage to a man, and he divorced her. When her waiting period ('idda) was completed, he sent a proposal for marriage again. I said to him, 'I gave her to you in marriage, made her your wife, and honored you, then you divorced her, and now you send a proposal again. By Allah! She will never go back to you again.' The man was not bad (he was righteous), and my sister was also willing to return to him. At that time Allah the Exalted revealed this verse, 'Do not prevent women from marrying their former husbands...' (al-Baqara: 232). I said, 'O Messenger of Allah! Now (that Allah's command has come down) I will certainly comply (and marry her to him).' Then he married his sister to him." (Note: In the blessed verse the address is to the guardians (such as father, brother, etc.) of the woman, because arranging the marriage is their task. If the guardian's permission were not necessary, the address would not have been to the guardians of the woman.)
Urdu Translation
سیدنا معقل بن یسار رضی اللہ عنہ کہتے ہیں کہمیں نے اپنی بہن کا ایک شخص سے نکاح کر دیا تھا، اس نے میری بہن کو طلاق دے دی۔ جب اس کی عدت پوری ہو گئی تو اس نے دوبارہ نکاح کا پیغام بھیجا۔ میں نے اسے جواب دیا کہ میں نے اس کا تجھ سے نکاح کر دیا تھا اور اسے تیری بیوی بنا دیا اور تیری تعظیم کی پھر تو نے اسے طلاق دے دی، اب تو پھر پیغام دیتا ہے تو اللہ کی قسم! اب وہ لوٹ کر دوبارہ تیرے پاس نہیں آئے گی۔ وہ شخص کچھ برا نہ تھا (نیک بخت تھا) اور میری بہن بھی اس کی طرف رجوع کرنے پر راضی تھی، اس وقت اللہ تعالیٰ نے یہ آیت نازل کی کہ”تم عورتوں کو اپنے پہلے خاوند سے نکاح کرنے سے منع نہ کرو“(البقرہ: 232) میں نے کہا یا رسول اللہ! اب (اللہ کا حکم اتر آیا تو) میں ضرور بجا لاؤں گا (اس سے نکاح کر دوں گا)۔ پھر اس نے اپنی بہن کا نکاح اس سے کر دیا۔ (نوٹ: آیت مبارکہ میں خطاب (عورت کے) اولیاء (جیسے باپ، بھائی وغیرہ) سے کہا گیا ہے کیونکہ نکاح کروانا ان کا کام ہے۔ اگر ولی کی اجازت ضروری نہ ہوتی تو خطاب (عورت کے) اولیاء سے نہ ہوتا۔)[مختصر صحيح بخاري/حدیث: 1847]
