أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ أنبأ مُحَمَّدُ بْنُ عَبْدِ اللهِ بْنِ عَبْدِ الْحَكَمِ أنبأ ابْنُ وَهْبٍ أَخْبَرَنِي جَرِيرُ بْنُ حَازِمٍ عَنْ سُلَيْمَانَ بْنِ مِهْرَانَ عَنْ أَبِي ظَبْيَانَ عَنِ ابْنِ عَبَّاسٍ قَالَ مَرَّ عَلِيٌّ بِمَجْنُونَةِ بَنِي فُلَانٍ قَدْ زَنَتْ وَهِيَ تُرْجَمُ فَقَالَ عَلِيٌّ لِعُمَرَ ؓ يَا أَمِيرَ الْمُؤْمِنِينَ أَمَرْتَ بِرَجْمِ فُلَانَةَ؟ قَالَ نَعَمْ قَالَ أَمَا تَذْكُرُ قَوْلَ رَسُولِ اللهِ ﷺ رُفِعَ الْقَلَمُ عَنْ ثَلَاثٍ عَنِ النَّائِمِ حَتَّى يَسْتَيْقِظَ وَعَنِ الصَّبِيِّ حَتَّى يَحْتَلِمَ وَعَنِ الْمَجْنُونِ حَتَّى يُفِيقَ ؟ قَالَ نَعَمْ فَأَمَرَ بِهَا فَخَلَّى عَنْهَا
English Translation
Ibn 'Abbas reported: 'Ali passed by a madwoman from Banu so-and-so who had committed adultery and was being stoned. 'Ali said to 'Umar (may Allah be pleased with him): 'O Commander of the Faithful, did you order the stoning of so-and-so?' He said: 'Yes.' He said: 'Do you not remember the saying of the Messenger of Allah (peace be upon him): The pen is lifted from three: from the sleeper until he wakes, from the child until he reaches puberty, and from the insane until he recovers?' He said: 'Yes.' So he ordered that she be released.
