وَأَخْبَرَنَا أَبُو سَعِيدٍ ثنا أَبُو الْعَبَّاسِ ثنا الْحَسَنُ ثنا يَحْيَى ثنا ابْنُ الْمُبَارَكِ عَنْ يُونُسَ قَالَ سَأَلْتُ الزُّهْرِيَّ عَنْ زَكَاةِ الْأَرْضِ الَّتِي عَلَيْهَا الْجِزْيَةُ فَقَالَ لَمْ يَزَلِ الْمُسْلِمُونَ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ وَبَعْدَهُ يُعَامَلُونَ عَلَى الْأَرْضِ وَيَسْتَكْرُونَهَا وَيُؤَدُّونَ الزَّكَاةَ مِمَّا خَرَجَ مِنْهَا فَنَرَى هَذِهِ الْأَرْضَ عَلَى نَ��ْوِ ذَلِكَ وَالْكَلَامُ فِي سَوَادِ الْعِرَاقِ مَوْضِعُهُ كِتَابُ الْجِزْيَةِ فَأَمَّا الْحَدِيثُ الَّذِي
English Translation
Abu Sa'id narrated to us: Abu al-Abbas narrated to us: al-Hasan narrated to us: Yahya narrated to us: Ibn al-Mubarak narrated from Yunus, who said: I asked al-Zuhri about the zakah on land that has jizya on it. He said: The Muslims in the time of the Messenger of Allah (peace be upon him) and after him continued to cultivate the land and rent it and pay zakah on what it produced. So we consider this land to be of the same nature. The discussion about the lands of Iraq belongs in the Book of Jizya. As for the hadith which -
