أَخْبَرَنَا أَبُو نَصْرٍ عُمَرُ بْنُ عَبْدِ الْعَزِيزِ بْنِ عُمَرَ بْنِ قَتَادَةَ أنبأ أَبُو عُمَرَ إِسْمَاعِيلُ بْنُ نُجَيْدٍ السُّلَمِيُّ أنبأ أَبُو مُسْلِمٍ إِبْرَاهِيمُ بْنُ عَبْدِ اللهِ ثنا أَبُو عَاصِمٍ أنبأ ابْنُ جُرَيْجٍ أَخْبَرَنِي عُمَرُ أَنَّ حِيَّ بْنَ يَعْلَى أَخْبَرَهُ أَنَّهُ سَمِعَ يَعْلَى قَالَ ابْتَاعَ عَبْدُ الرَّحْمَنِ بْنُ أُمَيَّةَ أ��خُو يَعْلَى مِنْ رَجُلٍ فَرَسًا أُنْثَى بِمِائَةِ قَلُوصٍ فَبَدَا لَهُ فَنَدِمَ الْبَائِعُ فَأَتَى عُمَرَ ؓ فَقَالَ إِنَّ يَعْلَى وَأَخَاهُ غَصَبَانِي فَرَسِي فَكَتَبَ عُمَرُ إِلَى يَعْلَى بْنِ أُمَيَّةَ أَنِ الْحَقْ بِي فَأَتَاهُ فَأَخْبَرَهُ فَقَالَ إِنَّ الْخَيْلَ لَتَبْلُغُ هَذَا عِنْدَكُمْ قَالَ مَا عَلِمْتُ فَرَسًا قَبْلَ هَذِهِ بَلَغَ هَذَا فَقَالَ عُمَرُ فَنَأْخُذُ مِنْ كُلِّ أَرْبَعِينَ شَاةً شَاةً وَلَا نَأْخُذُ مِنَ الْخَيْلِ شَيْئًا خُذْ مِنْ كُلِّ فَرَسٍ دِينَارًا قَالَ فَضَرَبَ عَلَى الْخَيْلِ دِينَارًا دِينَارًا وَقَدْ رُوِّينَا فِي الْبَابِ قَبْلَهُ مَا دَلَّ عَلَى أَنَّ عُمَرَ ؓ إِنَّمَا أَمَرَ بِذَلِكَ حِينَ أَحَبَّهُ أَرْبَابُهَا وَهَذِهِ الرِّوَايَةُ إِنْ صَحَّتْ تَكُونُ مَحْمُولَةً عَلَى مِثْلِ ذَلِكَ لَا تَتَّفِقُ الرِّوَايَاتُ وَلَا تَخْتَلِفُ وَحَدِيثُ عِرَاكٍ عَنْ أَبِي هُرَيْرَةَ أَصَحُّ مَا رُوِيَ فِي ذَلِكَ وَهُوَ يَقْطَعُ بِنَفْيِ الصَّدَقَةِ عَنْهَا وَاللهُ أَعْلَمُ
English Translation
Abu Nasr 'Umar ibn 'Abd al-'Aziz ibn 'Umar ibn Qatadah narrated to us... from Ya'la who said: 'Abd al-Rahman ibn Umayyah, the brother of Ya'la, purchased from a man a female horse for one hundred young female camels. Then he changed his mind, and the seller regretted it. He came to 'Umar (may Allah be pleased with him) and said: Ya'la and his brother have taken my horse by force. 'Umar wrote to Ya'la ibn Umayyah to come to him. He came and informed him. 'Umar said: Do horses reach this price among you? He said: I do not know of a horse before this one that reached this price. 'Umar said: We take from every forty sheep one sheep but we do not take anything from horses? Take from every horse one dinar. So he imposed one dinar on each horse. We have previously narrated in the chapter before what indicates that 'Umar only ordered this when the owners wished it. This narration, if authentic, would be understood in the same way so the reports are consistent. The hadith of 'Irak from Abu Hurayrah is the most authentic narration on this matter, and it definitively negates charity on horses. And Allah knows best.
