أَخْبَرَنَا أَبُو زَكَرِيَّا بْنُ أَبِي إِسْحَاقَ الْمُزَكِّي أنا أَبُو عَبْدِ اللهِ مُحَمَّدُ بْنُ يَعْقُوبَ ثنا أَبُو أَحْمَدَ مُحَمَّدُ بْنُ عَبْدِ الْوَهَّابِ أنا جَعْفَرُ بْنُ عَوْنٍ أنا يَحْيَى بْنُ سَعِيدٍ عَنِ الْقَاسِمِ بْنِ مُحَمَّدٍ قَالَ جَاءَ رَجُلٌ إِلَى ابْنِ عَبَّاسٍ فَقَالَ يَا أَبَا عَبَّاسٍ إِنَّ لِي إِبِلًا وَأَنَا أَمْنَحُ مِنْهَا وَأُفْقِرُ وَفِي حِجْرِي يَتِيمٌ وَلَهُ إِبِلٌ فَمَا يَحِلُّ لِي مِنْ إِبِلِ يَتِيمِي؟ قَالَ إِنْ كُنْتَ تَبْغِي ضَالَّةَ إِبِلِهِ وَتَهْنَأُ جَرْبَاهَا وَتَلُوطُ حِيَاضَهَا وَتَسْعَى عَلَيْهَا فَاشْرَبْ غَيْرَ مُضِرٍّ بِنَسْلٍ وَلَا نَاهِكٍ فِي حَلْبٍ وَقَدْ رُوِّينَا فِي كِتَابِ الْبُيُوعِ عَنْ عَمْرِو بْنِ عَبَّاسٍ فِي قَضَاءِ مَا أَكَلَ مِنْهُ إِذَا أَيْسَرَ وَهُوَ قَوْلُ عَبِيدَةَ وَمُجَاهِدٍ وَسَعِيدِ بْنِ جُبَيْرٍ وَأَبِي الْعَالِيَةِ وَرُوِّينَا عَنِ الْحَسَنِ الْبَصْرِيِّ وَعَطَاءِ بْنِ أَبِي رَبَاحٍ لَا يَقْضِيَهُ وَاللهُ أَعْلَمُ
English Translation
A man came to Ibn Abbas and said: 'O Abu Abbas, I have camels and I lend them and let others ride them, and I have an orphan in my care who also has camels. What is permissible for me from my orphan's camels?' He said: 'If you search for his lost camels, treat the mange of his sick ones, maintain his watering troughs, and tend to them, then drink without harming the offspring and without being excessive in milking.' We have also narrated in the Book of Sales from Amr ibn Abbas about repaying what one consumes from it when one becomes wealthy. This is the view of Abidah, Mujahid, Sa'id ibn Jubayr, and Abu al-Aliyah. And we narrated from al-Hasan al-Basri and 'Ata' ibn Abi Rabah that it need not be repaid. And Allah knows best.
