أَخْبَرَنَا أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو ثنا أَبُو عَبْدِ اللهِ بْنُ يَعْقُوبَ ثنا مُحَمَّدُ بْنُ نَصْرٍ ثنا مُحَمَّدُ بْنُ بَكَّارٍ ح وَأَخْبَرَنَا أَبُو بَكْرٍ مُحَمَّدُ بْنُ إِبْرَاهِيمَ الْفَارِسِيُّ ثنا إِسْمَاعِيلُ بْنُ أَحْمَدَ الْخَلَّالِيُّ أنا أَبُو يَعْلَى الْمَوْصِلِيُّ ثنا مُحَمَّدُ بْنُ بَكَّارٍ ثنا عَبْدُ الرَّحْمَنِ بْنُ أَبِي الزِّنَادِ عَنْ أَبِيهِ عَنْ خَارِجَةَ بْنِ زَيْدِ بْنِ ثَابِتٍ الْأَنْصَارِيِّ عَنْ أَبِيهِ زَيْدِ بْنِ ثَابِتٍ أَنَّ مَعَانِيَ هَذِهِ الْفَرَائِضِ وَأُصُولَهَا عَنْ زَيْدِ بْنِ ث��بتٍ وَأَمَّا التَّفْسِيرُ فَتَفْسِيرُ أَبِي الزِّنَادِ عَلَى مَعَانِي زَيْدٍ قَالَ وَمِيرَاثُ الْجَدِّ أَبِي الْأَبِ أَنَّهُ لَا يَرِثُ مَعَ أَبٍ دُنْيَا شَيْئًا وَهُوَ مَعَ الْوَلَدِ الذَّكَرِ وَمَعَ ابْنِ الِابْنِ يُفْرَضُ لَهُ السُّدُسُ وَفِيمَا سِوَى ذَلِكَ مَا لَمْ يَتْرُكِ الْمُتَوَفَّى أَخًا أَوْ أُخْتًا مِنْ أَبِيهِ يَخْلُفُ الْجَدُّ وَيُبْدَأُ بِأَحَدٍ إِنْ شَرَكَهُ مِنْ أَهْلِ الْفَرَائِضِ فَيُعْطَى فَرِيضَتَهُ فَإِنْ فَضَلَ مِنَ الْمَالِ السُّدُسُ فَأَكْثَرُ مِنْهُ كَانَ لِلْجَدِّ وَإِنْ لَمْ يَفْضُلِ السُّدُسُ فَأَكْثَرُ مِنْهُ فَلِلْجَدِّ السُّدُسُ
English Translation
Abu Sa'id ibn Abi Amr informed us: Abu Abdullah ibn Ya'qub narrated to us: Muhammad ibn Nasr narrated to us: Muhammad ibn Bakkar narrated. And Abu Bakr Muhammad ibn Ibrahim al-Farisi informed us: Isma'il ibn Ahmad al-Khallali narrated to us: Abu Ya'la al-Mawsili informed us: Muhammad ibn Bakkar narrated to us: Abd al-Rahman ibn Abi al-Zinad narrated from his father from Kharijah ibn Zayd ibn Thabit al-Ansari from his father Zayd ibn Thabit regarding the principles and foundations of these inheritance laws from Zayd ibn Thabit. As for the explanation, it is Abu al-Zinad's interpretation based on Zayd's principles. He said: Regarding the inheritance of the paternal grandfather, he does not inherit anything alongside a direct father, and alongside a male child or grandson, he is assigned a sixth. In other cases, as long as the deceased did not leave a brother or sister from his father, the grandfather takes the residuary. Priority is given to those with fixed shares, and if a sixth or more remains, it goes to the grandfather; if less than a sixth remains, the grandfather still receives a sixth.
