أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ وَأَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو قَالَا ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ ثنا يَحْيَى بْنُ أَبِي طَالِبٍ ثنا يَزِيدُ ثنا مُحَمَّدُ بْنُ سَالِمٍ عَنِ الشَّعْبِيِّ عَنْ مَسْرُوقٍ عَنْ عَبْدِ اللهِ قَالَ الْخَالَةُ بِمَنْزِلَةِ الْأُمِّ وَالْعَمَّةُ بِمَنْزِلَةِ الْأَبِ وَابْنَةُ الْأَخِ بِمَنْزِلَةِ الْأَخِ وَكُلُّ ذِي رَحِمٍ بِمَنْزِلَةِ الرَّحِمِ الَّتِي تَلِيهِ إِذَا لَمْ يَكُنْ وَارِثٌ ذُو قَرَابَةٍ وَرُوِّينَا عَنْ أَبِي إِسْحَاقَ السَّبِيعِيِّ عَنِ الشَّعْبِيِّ عَنْ مَسْرُوقٍ قَالَ قَالَ عَبْدُ اللهِ أَنْزِلُوهُمْ مَنَازِلَ آبَائِهِمْ يَقُولُ وَرِّثْ كُلَّ إِنْسَانٍ بِمَنْزِلَةِ أَبِيهِ
English Translation
Abu Abdullah al-Hafiz and Abu Sa'id ibn Abi Amr informed us: Abu al-Abbas Muhammad ibn Ya'qub narrated to us: Yahya ibn Abi Talib narrated to us: Yazid narrated to us: Muhammad ibn Salim narrated from al-Sha'bi from Masruq from Abdullah who said: The maternal aunt holds the position of the mother, the paternal aunt holds the position of the father, the daughter of the brother holds the position of the brother, and every relative by kinship holds the position of the kinship nearest to them when there is no heir of established relationship. And we narrated from Abu Ishaq al-Sabi'i from al-Sha'bi from Masruq who said: Abdullah said: Assign them the positions of their fathers - meaning: give each person the inheritance according to the position of their father.
