أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ ثنا يَحْيَى بْنُ أَبِي طَالِبٍ ثنا يَزِيدُ بْنُ هَارُونَ أنا دَاوُدُ بْنُ أَبِي هِنْدَ عَنِ الشَّعْبِيِّ قَالَ أُتِيَ زِيَادٌ فِي رَجُلٍ تُوُفِّيَ وَتَرَكَ عَمَّتَهُ وَخَالَتَهُ فَقَالَ هَلْ تَدْرُونَ كَيْفَ قَضَى عُمَرُ ؓ فِيهَا؟ قَالُوا لَا فَقَالَ وَاللهِ إِنِّي لَأَعْلَمُ النَّاسِ بِقَضَاءِ عُمَرَ فِيهَا جَعَلَ الْعَمَّةَ بِمَنْزِلَةِ الْأَخِ وَالْخَالَةَ بِمَنْزِلَةِ الْأُخْتِ فَأَعْطَى الْعَمَّةَ الثُّلُثَيْنِ وَالْخَالَةَ الثُّلُثَ وَرَوَاهُ الْحَسَنُ وَجَابِرُ بْنُ زَيْدٍ وَبَكْرُ بْنُ عَبْدِ اللهِ الْمُزَنِيُّ وَغَيْرُهُمْ أَنَّ عُمَرَ ؓ جَعَلَ لِلْعَمَّةِ الثُّلُثَيْنِ وَلِلْخَالَةِ الثُّلُثَ وَجَمِيعُ ذَلِكَ مَرَاسِيلُ وَرِوَايَةُ الْمَدَنِيِّينَ عَنْ عُمَرَ أَوْلَى أَنْ تَكُونَ صَحِيحَةً وَاللهُ أَعْلَمُ
English Translation
Abu Abdullah al-Hafiz informed us: Abu al-Abbas Muhammad ibn Ya'qub narrated to us: Yahya ibn Abi Talib narrated to us: Yazid ibn Harun informed us: Dawud ibn Abi Hind narrated from al-Sha'bi who said: Ziyad was approached regarding a man who died leaving his paternal aunt and maternal aunt. He said: Do you know how Umar (may Allah be pleased with him) judged in this case? They said: No. He said: By Allah, I am the most knowledgeable of people regarding Umar's judgment in this. He gave the paternal aunt the position of a brother and the maternal aunt the position of a sister, so he gave the paternal aunt two-thirds and the maternal aunt one-third. Al-Hasan, Jabir ibn Zayd, Bakr ibn Abdullah al-Muzani, and others also narrated that Umar gave the paternal aunt two-thirds and the maternal aunt one-third. All of these are mursal (disconnected) narrations, and the narration of the Madinans from Umar is more likely to be authentic. And Allah knows best.
