أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ وَأَبُو بَكْرِ بْنُ الْحَسَنِ الْقَاضِي قَالَا ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ ثنا مُحَمَّدُ بْنُ إِسْحَاقَ ثنا هَاشِمُ بْنُ الْقَاسِمِ ثنا شُعْبَةُ عَنْ بُدَيْلٍ الْعُقَيْلِيِّ قَالَ سَمِعْتُ عَلِيَّ بْنَ أَبِي طَلْحَةَ يُحَدِّثُ عَنْ رَاشِدِ بْنِ سَعْدٍ عَنْ أَبِي عَامِرٍ الْهَوْزَنِيِّ عَنِ الْمِقْدَامِ صَاحِبِ رَسُولِ اللهِ ﷺ عَنِ النَّبِيِّ ﷺ قَالَ مَنْ تَرَكَ كَلًّا فَإِلَيْنَا وَرُبَّمَا قَالَ إِلَى اللهِ وَرَسُولِهِ وَمَنْ تَرَكَ مَالًا فَلِوَرَثَتِهِ وَأَنَا وَارِثُ مَنْ لَا وَارِثَ لَهُ أَعْقِلُ عَنْ��ُ وَأَرِثُهُ وَالْخَالُ وَارِثُ مَنْ لَا وَارِثَ لَهُ يَعْقِلُ عَنْهُ وَيَرِثُهُ
English Translation
Abu Abdullah al-Hafiz and Abu Bakr ibn al-Hasan the judge informed us: Abu al-Abbas Muhammad ibn Ya'qub narrated to us: Muhammad ibn Ishaq narrated to us: Hashim ibn al-Qasim narrated to us: Shu'bah narrated from Budayl al-Uqayli who said: I heard Ali ibn Abi Talhah narrating from Rashid ibn Sa'd from Abu Amir al-Hawzani from al-Miqdam, a companion of the Messenger of Allah (peace be upon him), from the Prophet (peace be upon him) who said: Whoever leaves behind dependents, they are our responsibility - and perhaps he said: they are Allah's and His Messenger's responsibility. And whoever leaves behind wealth, it is for his heirs. And I am the heir of whoever has no heir; I pay his blood money and inherit from him. And the maternal uncle is the heir of whoever has no heir; he pays his blood money and inherits from him.
