أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ وَأَبُو بَكْرٍ أَحْمَدُ بْنُ الْحَسَنِ الْقَاضِي قَالَا ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ ثنا مُحَمَّدُ بْنُ إِسْحَاقَ الصَّغَانِيُّ ثنا قَبِيصَةُ بْنُ عُقْبَةَ ثنا سُفْيَانُ عَنْ عَبْدِ الرَّحْمَنِ بْنِ الْحَارِثِ بْنِ عَيَّاشِ بْنِ أَبِي رَبِيعَةَ عَنْ حَكِيمِ بْنِ حَكِيمِ بْنِ عَبَّادِ بْنِ حُنَيْفٍ عَنْ أَبِي أُمَامَةَ بْنِ سَهْلِ بْنِ حُنَيْفٍ قَالَ كَتَبَ عُمَرُ ب��نُ الْخَطَّابِ ؓ إِلَى أَبِي عُبَيْدَةَ بْنِ الْجَرَّاحِ ؓ أَنْ عَلِّمُوا غِلْمَانَكُمُ الْعَوْمَ وَمُقَاتِلَتَكُمُ الرَّمْيَ قَالَ وَكَانُوا يَخْتَلِفُونَ بَيْنَ الْأَغْرَاضِ فَجَاءَ سَهْمٌ غَرْبٌ فَأَصَابَ غُلَامًا فَقَتَلَهُ فِي حِجْرِ خَالٍ لَهُ لَا يُعْلَمُ لَهُ أَصْلٌ قَالَ فَكَتَبَ أَبُو عُبَيْدَةَ إِلَى عُمَرَ بْنِ الْخَطَّابِ ؓ يَسْأَلُهُ إِلَى مَنْ يَدْفَعُ عَقْلَهُ قَالَ فَكَتَبَ إِلَيْهِ عُمَرُ أَنَّ رَسُولَ اللهِ ﷺ كَانَ يَقُولُ اللهُ وَرَسُولُهُ مَوْلَى مَنْ لَا مَوْلَى لَهُ وَالْخَالُ وَارِثُ مَنْ لَا وَارِثَ لَهُ
English Translation
Abu Abdullah al-Hafiz and Abu Bakr Ahmad ibn al-Hasan the judge informed us: Abu al-Abbas Muhammad ibn Ya'qub narrated to us: Muhammad ibn Ishaq al-Saghani narrated to us: Qabisah ibn Uqbah narrated to us: Sufyan narrated from Abd al-Rahman ibn al-Harith ibn Ayyash ibn Abi Rabi'ah from Hakim ibn Hakim ibn Abbad ibn Hunayf from Abu Umamah ibn Sahl ibn Hunayf who said: Umar ibn al-Khattab (may Allah be pleased with him) wrote to Abu Ubaydah ibn al-Jarrah (may Allah be pleased with him): Teach your boys swimming and your fighters archery. They used to go back and forth between the targets. Then a stray arrow came and struck a boy and killed him. He was in the care of a maternal uncle and had no known origin. Abu Ubaydah wrote to Umar ibn al-Khattab asking to whom should his blood money be given. Umar wrote back that the Messenger of Allah (peace be upon him) used to say: Allah and His Messenger are the protector of whoever has no protector, and the maternal uncle is the heir of whoever has no heir.
