حَدَّثَنَا إِسْمَاعِيلُ عَنْ يُونُسَ عَنِ الْحَسَنِ عَنْ سَلَمَةَ بْنِ الْمُحَبِّقِ أَنَّ رَجُلًا خَرَجَ فِي غَزَاةٍ وَمَعَهُ جَارِيَةٌ لِامْرَأَتِهِ فَوَقَعَ بِهَا فَذُكِرَ لِلنَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ إِنْ كَانَ اسْتَكْرَهَهَا فَهِيَ عَتِيقَةٌ وَلَهَا عَلَيْهِ مِثْلُهَا وَإِنْ كَانَتْ طَاوَعَتْهُ فَهِيَ أَمَتُهُ وَلَهَا عَلَيْهِ مِثْلُهَا وَقَالَ إِسْمَاعِيلُ مَرَّةً إِنَّ رَجُلًا كَانَ فِي غَزْوَةٍ حَدَّثَنَا هُشَيْمٌ عَنْ يُونُسَ عَنِ الْحَسَنِ عَنْ سَلَمَةَ بْنِ الْمُحَبِّقِ عَنْ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَذَكَرَ مَعْنَاهُ حَدَّثَنَا مُحَمَّدُ بْنُ جَعْفَرٍ حَدَّثَنَا شُعْبَةُ عَنْ قَتَادَةَ عَنِ الْحَسَنِ عَنْ سَلَمَةَ بْنِ الْمُحَبِّقِ عَنْ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مِثْلَهُ.
English Translation
Isma'il, from Yunus, from al-Hasan, from Salama ibn al-Muhabbiq, that a man went out on a military expedition, having with him his wife's slave-girl, and he had intercourse with her; this was mentioned to the Prophet (peace and blessings be upon him), who said: "If he coerced her, then she is freed, and she is owed her equivalent from him; but if she consented, then she is his slave-girl, and she is owed her equivalent from him." Isma'il said once: "A man was on a military expedition..." Hushaym narrated to us, from Yunus, from al-Hasan, from Salama ibn al-Muhabbiq, from the Prophet (peace and blessings be upon him), mentioning something similar. Muhammad ibn Ja'far narrated to us, Shu'ba narrated to us, from Qatada, from al-Hasan, from Salama ibn al-Muhabbiq, from the Prophet (peace and blessings be upon him), the same.
