حَدَّثَنَا مُحَمَّدُ بْنُ جَعْفَرٍ حَدَّثَنَا شُعْبَةُ عَنِ الْحَكَمِ قَالَ سَمِعْتُ ابْنَ أَبِي لَيْلَى يُحَدِّثُ عَنْ رَجُلٍ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ لَا يُتَلَقَّى جَلَبٌ وَلَا يَبِعْ حَاضِرٌ لِبَادٍ وَمَنْ اشْتَرَى شَاةً مُصَرَّاةً أَوْ نَاقَةً قَالَ شُعْبَةُ إِنَّمَا قَالَ نَاقَةً مَرَّةً وَاحِدَةً فَهُوَ فِيهَا بِآخِرِ النَّظَرَيْنِ إِذَا هُوَ حَلَبَ إِنْ رَدَّهَا رَدَّ مَعَهَا صَاعًا مِنْ طَعَامٍ قَالَ الْحَكَمُ أَوْ قَالَ صَاعًا مِنْ تَمْرٍ.
English Translation
Muhammad ibn Ja'far told us: Shu'bah told us, from al-Hakam, who said: I heard Ibn Abi Layla narrate from a man among the Companions of the Prophet (peace and blessings be upon him), who said: "Goods being brought to market must not be intercepted, nor may a townsman sell on behalf of a nomad; and whoever buys a sheep or a she-camel whose udder has been left untapped" - Shu'bah said: he mentioned "she-camel" only once - "he has the choice between the two options once he has milked it: if he returns it, he returns with it a sa' of food" - al-Hakam said, or he said, "a sa' of dates."
