حَدَّثَنَا عَبْدُ الرَّحْمَنِ بْنُ مَهْدِيٍّ عَنْ سُفْيَانَ عَنْ مَنْصُورٍ عَنْ إِبْرَاهِيمَ عَنْ عُبَيْدِ بْنِ نُضَيْلَةَ عَنِ الْمُغِيرَةِ بْنِ شُعْبَةَ أَنَّ امْرَأَتَيْنِ ضَرَبَتْ إِحْدَاهُمَا الْأُخْرَى بِعَمُودِ فُسْطَاطٍ فَقَتَلَتْهَا فَقَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِالدِّيَةِ عَلَى عَصَبَةِ الْقَاتِلَةِ وَفِيمَا فِي بَطْنِهَا غُرَّةٌ قَالَ الْأَعْرَابِيُّ أَتُغَرِّمُنِي مَنْ لَا أَكَلَ وَلَا شَرِبَ وَلَا صَاحَ فَاسْتَهَلَّ مِثْلُ ذَلِكَ يُطَلُّ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَسَجْعٌ كَسَجْعِ الْأَعْرَابِ وَبِمَا فِي بَطْنِهَا غُرَّةٌ.
English Translation
Abdul Rahman ibn Mahdi told us from Sufyan from Mansur from Ibrahim from Ubayd ibn Nudaylah from al-Mughirah ibn Shu'bah, that two women, one of them struck the other with a tent pole and killed her. The Messenger of Allah, peace and blessings be upon him, ruled that the blood money be upon the paternal relatives of the killer, and that for what was in her womb, a slave was due as compensation. The Bedouin said, "Should you fine me for one who neither ate nor drank, nor cried out nor wailed - the like of that is to be disregarded." The Messenger of Allah, peace and blessings be upon him, said, "Is this rhymed speech like the rhymed speech of the Bedouins? Yet for what is in her womb, a slave is due as compensation."
