حَدَّثَنَا عَتَّابٌ، عَنْ خُصَيْفٍ، عَنِ الشَّعْبِيِّ، فِيالرَّجُلِ يَتَزَوَّجُ الْمَرْأَةَ وَهِيَ بِبَلَدٍ آخَرَ فَيَقْذِفُهَا وَلَمْ يَرَهَا , قَالَ:" يُجْلَدُ وَلا لِعَانَ بَيْنَهُمَا، وَذَكَرَ أَنَّ الأَعْمَى بِتِلْكَ الْمَنْزِلَةِ، وَكُلُّ مَنْ لا يَجُوزُ شَهَادَتُهُ". قَالَ خُصَيْفٌ: قَالَ حَمَّادٌ:" كُلُّ مَخْرَجٍ جَعَلَهُ اللَّهُ لِلزَّوْجِ فَإِنْ رَآهَا أَوْ لَمْ يَرَهَا فَإِنَّهُمَا يَتَلاعَنَانِ , وَالأَعْمَى وَمَنْ لا تَجُوزُ شَهَادَتُهُ كَذَلِكَ، وَالْمُرْتَدُّ كَذَلِكَ".
الترجمة الإنجليزية
Al-Sha'bi said regarding a man who marries a woman in another city without having seen her and then accuses her of adultery: "He is flogged and there is no li'an between them. The same applies to a blind man and anyone whose testimony is not accepted." Hammad said: "Whatever exit Allah has given to the husband — whether he saw her or not — they perform li'an. The same applies to a blind man, one whose testimony is not accepted, and an apostate."
الترجمة الأردية
حضرت شعبی رحمہ اللہ نے فرمایا: جو مرد بیوی سے دور شہر میں نکاح کرے اور قذف کرے مگر نہ دیکھے تو اس پر حد ہے اور لعان نہیں، نابینا اور غیر معتبر گواہ کے لیے بھی یہی حکم ہے، حضرت حماد رحمہ اللہ نے فرمایا: اگر مرد نے عورت کو دیکھا یا نہ دیکھا تب بھی لعان ہو گا، نابینا، ناقابل گواہ اور مرتد کا بھی یہی حکم ہے۔[سنن سعید بن منصور/كتاب الطلاق/حدیث: 2765]
