Abu Bakr ibn Abi Shaybah narrated to us. Waki' ibn al-Jarrah narrated to us from Sufyan. And Ishaq ibn Ibrahim narrated to us. Yahya ibn Adam informed us. Sufyan narrated to us, he said: He dictated it to us as a dictation. And 'Abdullah ibn Hashim narrated to me, and the wording is his. 'Abd al-Rahman, meaning Ibn Mahdi, narrated to me. Sufyan narrated to us from 'Alqamah ibn Marthad from Sulayman ibn Buraydah from his father, he said: The Beloved Messenger of Allah (peace and blessings of Allah be upon him), when he appointed a commander over an army or an expedition, would advise him privately to have taqwa of Allah, and to treat well the Muslims who were with him. Then he would say: «Fight in the name of Allah in the path of Allah. Fight those who disbelieve in Allah. Fight, and do not commit treachery, do not break covenants, do not mutilate, and do not kill children. When you meet your enemy from among the polytheists, call them to three qualities or characteristics, whichever of them they respond to, accept from them and refrain from them. Then call them to Islam. If they respond to you, accept from them and refrain from them. Then call them to move from their abode to the abode of the Muhajirun, and inform them that if they do so, they will have what the Muhajirun have and upon them will be what is upon the Muhajirun. But if they refuse to move from it, inform them that they will be like the Bedouin Muslims - the judgment of Allah that applies to the believers will apply to them, but they will have nothing of the spoils of war and fay' unless they fight alongside the Muslims. If they refuse, ask them for jizyah. If they respond to you, accept from them and refrain from them. But if they refuse, seek Allah's help and fight them. When you besiege the people of a fortress and they want you to grant them the protection of Allah and the protection of His Prophet, do not grant them the protection of Allah nor the protection of His Prophet, but grant them your protection and the protection of your companions. For indeed, if you violate your protection and the protection of your companions, it is easier than violating the protection of Allah and the protection of His Messenger. And when you besiege the people of a fortress and they want you to let them surrender according to Allah's judgment, do not let them surrender according to Allah's judgment, but let them surrender according to your judgment, for you do not know whether you will reach Allah's judgment regarding them or not.» 'Abd al-Rahman said: This or something similar to it. And Ishaq added at the end of his hadith from Yahya ibn Adam, he said: I mentioned this hadith to Muqatil ibn Hayyan. Yahya said, meaning that 'Alqamah said it to Ibn Hayyan. So he said: Muslim ibn Haysam narrated to me from al-Nu'man ibn Muqarrin from the Noble Prophet (peace and blessings of Allah be upon him) something similar.
