حَدَّثَنَا أَبُو كَامِلٍ قَالَ حَدَّثَنَا لَيْثٌ قَالَ حَدَّثَنِي سَعِيدُ بْنُ أَبِي سَعِيدٍ الْمَقْبُرِيُّ عَنْ أَبِي شُرَيْحٍ الْعَدَوِيِّ أَنَّهُ قَالَ لِعَمْرِو بْنِ سَعِيدٍ وَهُوَ يَبْعَثُ الْبُعُوثَ إِلَى مَكَّةَ ائْذَنْ لِي أَيُّهَا الْأَمِيرُ أُحَدِّثْكَ قَوْلًا قَامَ بِهِ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ الْغَدَ مِنْ يَوْمِ الْفَتْحِ سَمِعَتْهُ أُذُنَايَ وَوَعَاهُ قَلْبِي وَأَبْصَرَتْهُ عَيْنَايَ حَيْثُ تَكَلَّمَ بِهِ أَنَّهُ حَمِدَ اللَّهَ وَأَثْنَى عَلَيْهِ ثُمَّ قَالَ إِنَّ مَكَّةَ حَرَّمَهَا اللَّهُ وَلَمْ يُحَرِّمْهَا النَّاسُ فَلَا يَحِلُّ لِامْرِئٍ يُؤْمِنُ بِاللَّهِ وَالْيَوْمِ الْآخِرِ أَنْ يَسْفِكَ فِيهَا دَمًا وَلَا يَعْضِدَ فِيهَا شَجَرَةً فَإِنْ أَحَدٌ تَرَخَّصَ بِقِتَالِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِيهَا فَقُولُوا إِنَّ اللَّهَ عَزَّ وَجَلَّ أَذِنَ لِرَسُولِهِ وَلَمْ يَأْذَنْ لَكُمْ وَإِنَّمَا أَذِنَ لِي فِيهَا سَاعَةً مِنْ نَهَارٍ وَقَدْ عَادَتْ حُرْمَتُهَا الْيَوْمَ كَحُرْمَتِهَا بِالْأَمْسِ فَلْيُبَلِّغْ الشَّاهِدُ الْغَائِبَ فَقِيلَ لِأَبِي شُرَيْحٍ مَا قَالَ لَكَ عَمْرٌو قَالَ قَالَ أَنَا أَعْلَمُ بِذَلِكَ مِنْكَ يَا أَبَا شُرَيْحٍ إِنَّ الْحَرَمَ لَا يُعِيذُ عَاصِيًا وَلَا فَارًّا بِدَمٍ وَلَا فَارًّا بِجِزْيَةٍ وَكَذَلِكَ قَالَ حَجَّاجٌ بِجِزْيَةٍ وَقَالَ يَعْقُوبُ عَنْ أَبِيهِ عَنِ ابْنِ إِسْحَاقَ وَلَا مَانِعَ جِزْيَةٍ.

Abu Kamil narrated to us: Layth narrated to us: Sa'id ibn Abi Sa'id al-Maqburi narrated to me, from Abu Shurayh al-Adawi, that he said to Amr ibn Sa'id, while he was sending out expeditionary forces to Makkah, "Permit me, O commander, to tell you a saying that the Messenger of Allah, peace and blessings be upon him, delivered the day after the Conquest - my ears heard it, my heart retained it, and my eyes beheld him as he spoke it - that he praised Allah and extolled Him, then said, 'Allah has made Makkah sacred, and people did not make it sacred; so it is not lawful for anyone who believes in Allah and the Last Day to shed blood in it, nor to cut down a tree in it. If anyone claims license to fight in it citing the Messenger of Allah, peace and blessings be upon him, then say: Allah, Mighty and Majestic, permitted it to His Messenger, and did not permit it to you; He only permitted it to me for an hour of the day, and its sanctity has now returned today as it was yesterday - let those present convey this to those absent.'" It was said to Abu Shurayh, "What did Amr say to you?" He said, "He said, 'I know more about that than you do, O Abu Shurayh - the sanctuary does not shelter a wrongdoer, nor a fugitive from bloodshed, nor a fugitive owing a tribute (jizyah)'" - and Hajjaj likewise said "jizyah" - while Ya'qub, from his father, from Ibn Ishaq, said, "nor one withholding a jizyah."
