حَدَّثَنَا إِسْحَاقُ هُوَ ابْنُ عِيسَى حَدَّثَنَا مَالِكٌ عَنِ الزُّهْرِيِّ عَنْ حَرامِ بْنِ مُحَيِّصَةَ أَنَّ نَاقَةً لِلْبَرَاءِ دَخَلَتْ حَائِطًا فَأَفْسَدَتْ فِيهِ فَقَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنَّ عَلَى أَهْلِ الْحَوَائِطِ حِفْظَهَا بِالنَّهَارِ وَأَنَّ مَا أَفْسَدَتْ الْمَوَاشِي بِاللَّيْلِ ضَامِنٌ عَلَى أَهْلِهَا.
الترجمة الإنجليزية
Ishaq -- that is, Ibn Isa -- told us: Malik told us, from al-Zuhri, from Haram ibn Muhayyisah, that a she-camel belonging to al-Bara' entered an orchard and caused damage in it. The Messenger of Allah (peace and blessings be upon him) ruled that the owners of orchards were responsible for guarding them during the day, and that whatever livestock damaged at night was the responsibility of their owners.
