It is narrated that Hadrat Malik bin Aws bin Al-Hadathan (may Allah be well pleased with him) said: "Al-Abbas and Ali came to 'Umar with a dispute. Al-Abbas said: 'Pass judgment between him and I.' the people said: 'Pass judgment between them.' 'Umar said: 'I will not pass judgment between them. They know that the Beloved Messenger of Allah (blessings and peace of Allah be upon him) said: We are not inherited from, what we leave behind is charity. He said: And (in this narration of it) Az-Zuhri said: 'It (the Khumus) was under the control of the Beloved Messenger of Allah (blessings and peace of Allah be upon him) , and he took provision for himself and for his family from it, and disposed to the rest of it as he disposed of other wealth (belonging to the Muslims). Then Hadrat Abu Bakr took control of it, then I took control of it after Hadrat Abu Bakr, and I did with it what he sued to do. Then these two came to me and asked me to give it to them so that they could dispose of it as the Beloved Messenger of Allah (blessings and peace of Allah be upon him) disposed of it, and as Hadrat Abu Bakr disposed of it, and as I disposed of it. So I gave it to them and I took promises from them that they would take proper care of it. Then they came to me and this one said. Give me my share from my brothers son: and this one said: Give me my share from my wife. If they want me to give it to them on the condition that they would dispose of it in the same manner as the Beloved Messenger of Allah (blessings and peace of Allah be upon him) did, and as Hadrat Abu Bakr did, and as I did, I would give it to them, but if they refuse, then they do not have to worry about it.' Then he said: 'And know that whatever of spoils of war that you may gain, verily, one-fifth of it is assigned to Allah, and to the Messenger, and to the near relatives (of the Messenger (Muhammad (blessings and peace of Allah be upon him)), (and also) the orphans, Al-Masakin (the poor) and the wayfarer' (Al-Anfal 8:41) this if for them. 'As-Sadaqat (here it means Zakah) are only for the Fuqara (poor), and Al-Masakin (the poor) and those employed to collect (the funds); and to attract the hearts of those who have been inclined (toward Islam); and to free the captives; and for those in debt; and for Allah's cause (I.e. for Mujahidun - those fighting in a holy battle)' - this is for them. 'And what Allah gave as booty (Fay') to His Messenger (Muhammad (blessings and peace of Allah be upon him)) from them - for this you made no expeditin with either cavalry or camels.' Az-Zuhri said: This applies exclusively to the Beloved Messenger of Allah (blessings and peace of Allah be upon him) and refers to an 'Arab village called Fadak, and so on. What Allah gave as booty (Fay') to His Messenger (Muhammad (blessings and peace of Allah be upon him)) from the people of the townships - it is for Allah, His Messenger (Muhammad (blessings and peace of Allah be upon him)), the kindred (of Messenger Muhammad (blessings and peace of Allah be upon him)), the orphans, Al-Masakin (the poor), and the wayfarer (And there is also a share in this booty) for the poor emigrants, who were expelled from their homes and their property And (it is also for) those who, before them, had homes (in Al-Madinah) and had adopted the Faith And those who came after them. These is no one left among the Muslims but he has some rights to this wealth, except for some of the slaved whom you own. If I live, if Allah wills, I will give every Muslim his right." حضرت مالک بن اوس بن حدثان رضی اللہ تعالیٰ عنہ فرماتے ہیں: حضرت عباس رضی اللہ تعالیٰ عنہ اور حضرت علی المرتضیٰ کرّم اللہ تعالیٰ وجہہ الکریم حضرت عمر رضی اللہ تعالیٰ عنہ کے پاس اپنا جھگڑا لے کر آئے۔ حضرت عباس رضی اللہ تعالیٰ عنہ نے فرمایا: میرے اور اس کے درمیان فیصلہ کیجیے۔ لوگوں نے کہا: ان دونوں کے درمیان فیصلہ فرمائیے۔ حضرت عمر رضی اللہ تعالیٰ عنہ نے فرمایا: میں ان دونوں کے درمیان فیصلہ نہیں کروں گا، یہ دونوں جانتے ہیں کہ رسول اللہ صلی اللہ تعالیٰ علیہ وآلہ وسلم نے ارشاد فرمایا تھا: ہماری وراثت نہیں ہوتی، جو ہم چھوڑیں وہ صدقہ ہے۔ زہری نے فرمایا: اس (مال) کا انتظام رسول اللہ صلی اللہ تعالیٰ علیہ وآلہ وسلم کے پاس تھا، آپ اس میں سے اپنے اہل و عیال کی خوراک لیتے اور باقی کو عام مال کی طرح خرچ فرماتے۔ پھر آپ کے بعد حضرت ابوبکر رضی اللہ تعالیٰ عنہ نے اس کا انتظام سنبھالا، پھر حضرت ابوبکر رضی اللہ تعالیٰ عنہ کے بعد میں نے سنبھالا اور میں نے اس میں وہی کیا جو آپ صلی اللہ تعالیٰ علیہ وآلہ وسلم کرتے تھے۔ پھر یہ دونوں میرے پاس آئے اور مجھ سے درخواست کی کہ میں یہ مال ان کے حوالے کر دوں اس شرط پر کہ وہ اس کا انتظام ویسے ہی کریں جیسے رسول اللہ صلی اللہ تعالیٰ علیہ وآلہ وسلم نے کیا، حضرت ابوبکر رضی اللہ تعالیٰ عنہ نے کیا اور جیسے میں نے کیا۔ تو میں نے ان کے حوالے کر دیا اور ان سے اس بارے میں عہد لیا۔ پھر یہ دونوں میرے پاس آئے، یہ (حضرت عباس رضی اللہ تعالیٰ عنہ) کہتے ہیں: میرے بھتیجے کی طرف سے میرا حصہ الگ کر دیجیے، اور یہ (حضرت علی کرّم اللہ تعالیٰ وجہہ الکریم) کہتے ہیں: میری بیوی کی طرف سے میرا حصہ الگ کر دیجیے۔ اگر یہ چاہیں کہ میں اسے ان کے حوالے کر دوں اس شرط پر کہ اس کا انتظام ویسے ہی کریں جیسے رسول اللہ صلی اللہ تعالیٰ علیہ وآلہ وسلم نے کیا، حضرت ابوبکر رضی اللہ تعالیٰ عنہ نے کیا اور میں نے کیا، تو میں ان کے حوالے کر دوں گا، اور اگر انکار کریں تو ان کو اس کی فکر نہ ہو۔ پھر فرمایا: {وَاعْلَمُوا أَنَّمَا غَنِمْتُمْ مِنْ شَيْءٍ فَأَنَّ لِلَّهِ خُمُسَهُ وَلِلرَّسُولِ وَلِذِي الْقُرْبَى وَالْيَتَامَى وَالْمَسَاكِينِ وَابْنِ السَّبِيلِ} یہ ان لوگوں کے لیے ہے۔ {إِنَّمَا الصَّدَقَاتُ لِلْفُقَرَاءِ وَالْمَسَاكِينِ وَالْعَامِلِينَ عَلَيْهَا وَالْمُؤَلَّفَةِ قُلُوبُهُمْ وَفِي الرِّقَابِ وَالْغَارِمِينَ وَفِي سَبِيلِ اللَّهِ} یہ ان لوگوں کے لیے ہے۔ {وَمَا أَفَاءَ اللَّهُ عَلَى رَسُولِهِ مِنْهُمْ فَمَا أَوْجَفْتُمْ عَلَيْهِ مِنْ خَيْلٍ وَلاَ رِكَابٍ} زہری نے فرمایا: یہ خاص طور پر رسول اللہ صلی اللہ تعالیٰ علیہ وآلہ وسلم کے لیے تھا، عرب بستیاں جیسے فدک وغیرہ۔ {مَا أَفَاءَ اللَّهُ عَلَى رَسُولِهِ مِنْ أَهْلِ الْقُرَى فَلِلَّهِ وَلِلرَّسُولِ وَلِذِي الْقُرْبَى وَالْيَتَامَى وَالْمَسَاكِينِ وَابْنِ السَّبِيلِ} اور {لِلْفُقَرَاءِ الْمُهَاجِرِينَ الَّذِينَ أُخْرِجُوا مِنْ دِيَارِهِمْ وَأَمْوَالِهِمْ} اور {وَالَّذِينَ تَبَوَّءُوا الدَّارَ وَالإِيمَانَ مِنْ قَبْلِهِمْ} اور {وَالَّذِينَ جَاءُوا مِنْ بَعْدِهِمْ}۔ اس آیت نے تمام لوگوں کو شامل کر لیا، کوئی مسلمان ایسا نہیں رہا جس کا اس مال میں حق نہ ہو، سوائے تمہارے بعض غلاموں کے۔ اور اگر میں زندہ رہا تو ان شاء اللہ ہر مسلمان کو اس کا حق ضرور پہنچے گا۔
