وَقَالَ اللَّيْثُ حَدَّثَنِي نَافِعٌ، أَنَّ صَفِيَّةَ ابْنَةَ أَبِي عُبَيْدٍ، أَخْبَرَتْهُ أَنَّ عَبْدًا مِنْ رَقِيقِ الإِمَارَةِ وَقَعَ عَلَى وَلِيدَةٍ مِنَ الْخُمُسِ، فَاسْتَكْرَهَهَا حَتَّى افْتَضَّهَا، فَجَلَدَهُ عُمَرُ الْحَدَّ وَنَفَاهُ، وَلَمْ يَجْلِدِ الْوَلِيدَةَ مِنْ أَجْلِ أَنَّهُ اسْتَكْرَهَهَا. قَالَ الزُّهْرِيُّ فِي الأَمَةِ الْبِكْرِ، يَفْتَرِعُهَا الْحُرُّ، يُقِيمُ ذَلِكَ الْحَكَمُ مِنَ الأَمَةِ الْعَذْرَاءِ بِقَدْرِ قِيمَتِهَا، وَيُجْلَدُ، وَلَيْسَ فِي الأَمَةِ الثَّيِّبِ فِي قَضَاءِ الأَئِمَّةِ غُرْمٌ، وَلَكِنْ عَلَيْهِ الْحَدُّ.
انگریزی ترجمہ
Hadrat Safiyya bint Abi Ubaid (may the mercy of Allah be upon her) narrates that a slave belonging to the government forced himself upon a slave-girl from the fifth portion (of war booty) and violated her virginity. Hadrat Umar (may Allah be well pleased with him) had the slave flogged with the prescribed punishment and exiled him, but did not punish the slave-girl because she had been forced. Az-Zuhri (may the mercy of Allah be upon him) said regarding a virgin slave-girl violated by a free man: The judge should collect compensation from the violator equivalent to the decrease in her value due to loss of virginity and also have him flogged. If the slave-girl was previously married (non-virgin), then according to the rulings of the authorities, there is no monetary compensation, but the prescribed punishment must be carried out.
اردو ترجمہ
حضرت اُمّ المؤمنین صفیہ بنت ابی عبید رحمۃ اللہ تعالیٰ علیہا سے روایت ہے کہ حکومت کے غلاموں میں سے ایک غلام نے حصۂ خمس کی ایک باندی سے زبردستی ہمبستری کی اور اس کی بکارت ختم کر دی۔ تو حضرت عمر رضی اللہ تعالیٰ عنہ نے اس غلام پر حد جاری فرمائی اور اسے جلاوطن بھی کر دیا، لیکن باندی پر حد جاری نہ کی کیونکہ غلام نے اس کے ساتھ زبردستی کی تھی۔ زہری رحمۃ اللہ تعالیٰ علیہ نے فرمایا: اگر کوئی آزاد شخص کنواری باندی سے زنا کرے تو حاکم اس شخص سے اتنا تاوان وصول کرے جتنی بکارت جانے سے باندی کی قیمت کم ہو، نیز اسے کوڑے بھی لگائے۔ اور اگر باندی شادی شدہ (ثیبہ) ہو تو اماموں کے فیصلے میں مالی تاوان نہیں ہے، صرف حد لازم ہے۔
