Narrated to us by Ubaid bin Ismail, narrated to us by Abu Hadrat Usamah, from Hisham, from his father, that Umm al-Mu'minin Hadrat Aisha Siddiqah (may Allah be well pleased with her) stated that Hadrat Barirah (may Allah be well pleased with her) came and submitted, 'I have entered into a contract of emancipation (kitabah) with my masters for nine awaq, one uqiyyah to be paid each year. Please help me.' Hadrat Aisha (may Allah be well pleased with her) said, 'If your masters agree that I pay them the full amount at once and set you free, I shall do so, and the wala (patronage) shall be mine.' Barirah (may Allah be well pleased with her) went to her masters but they refused. Barirah (may Allah be well pleased with her) submitted, 'I presented this offer to them but they refused; they want the wala to remain theirs.' The Beloved Messenger of Allah (blessings and peace of Allah be upon him) heard of this and asked me about it. I informed him of the entire matter. He (blessings and peace of Allah be upon him) declared, 'Take her and set her free, and let them stipulate the wala for themselves, for the wala belongs only to the one who sets free.' Hadrat Aisha (may Allah be well pleased with her) stated that then the Beloved Messenger of Allah (blessings and peace of Allah be upon him) stood up among the people, praised Allah Almighty and glorified Him, then declared, 'After praising Allah and sending salutations, what is the matter with some of you who stipulate conditions that are not in the Book of Allah! Any condition that is not in the Book of Allah is void, even if there be a hundred conditions. The decree of Allah is more rightful, and the condition of Allah is more binding. What is the matter with some of you that one of you says: Set free, O so-and-so, and the wala shall be mine! The wala belongs only to the one who sets free.'
اردو ترجمہ
ہم سے عبید بن اسماعیل نے بیان کیا، کہا ہم سے ابو اسامہ نے بیان کیا، ہشام سے، ان کے والد سے، حضرت اُمّ المؤمنین عائشہ صدیقہ رضی اللہ تعالیٰ عنہا نے فرمایا کہ حضرت بریرہ رضی اللہ تعالیٰ عنہا آئیں اور عرض کیا کہ میں نے اپنے مالکوں سے نو اوقیہ پر کتابت کا معاہدہ کیا ہے، ہر سال ایک اوقیہ ادا کرنا ہے، تو میری مدد فرمائیں۔ حضرت اُمّ المؤمنین عائشہ رضی اللہ تعالیٰ عنہا نے فرمایا کہ اگر تمہارے مالک اس پر راضی ہوں کہ میں ان کو ایک ہی مرتبہ پوری رقم دے دوں اور تمہیں آزاد کر دوں تو میں ایسا کروں گی، اور ولاء میری ہو گی۔ بریرہ رضی اللہ تعالیٰ عنہا اپنے مالکوں کے پاس گئیں لیکن انہوں نے انکار کر دیا۔ بریرہ رضی اللہ تعالیٰ عنہا نے عرض کیا کہ میں نے ان کے سامنے یہ بات رکھی لیکن انہوں نے انکار کر دیا، وہ چاہتے ہیں کہ ولاء ان کی ہو۔ رسول اللہ صلی اللہ تعالیٰ علیہ وآلہ وسلم نے یہ بات سنی تو مجھ سے دریافت فرمایا، میں نے سارا حال عرض کیا۔ آپ صلی اللہ تعالیٰ علیہ وآلہ وسلم نے ارشاد فرمایا کہ اسے لے لو اور آزاد کر دو، اور ان کے لیے ولاء کی شرط مان لو، کیونکہ ولاء تو صرف آزاد کرنے والے کی ہوتی ہے۔ حضرت اُمّ المؤمنین عائشہ رضی اللہ تعالیٰ عنہا نے فرمایا کہ پھر رسول اللہ صلی اللہ تعالیٰ علیہ وآلہ وسلم لوگوں میں کھڑے ہوئے، اللہ تعالیٰ کی حمد و ثنا بیان فرمائی، پھر ارشاد فرمایا: حمد و صلوٰۃ کے بعد! تم میں سے کچھ لوگوں کو کیا ہو گیا ہے کہ وہ ایسی شرطیں لگاتے ہیں جو کتاب اللہ میں نہیں ہیں! جو بھی شرط کتاب اللہ میں نہیں ہے وہ باطل ہے، خواہ سو شرطیں ہوں۔ اللہ تعالیٰ کا فیصلہ زیادہ حق دار ہے اور اللہ تعالیٰ کی شرط زیادہ مضبوط ہے۔ تم میں سے بعض لوگوں کو کیا ہو گیا ہے کہ ان میں سے کوئی کہتا ہے کہ اے فلاں! تم آزاد کرو لیکن ولاء میری ہو گی۔ ولاء تو صرف آزاد کرنے والے کی ہوتی ہے۔
