أَخْبَرَنَا أَبُو نَصْرٍ عُمَرُ بْنُ عَبْدِ الْعَزِيزِ بْنِ عُمَرَ بْنِ قَتَادَةَ مِنْ كِتَابِهِ أنبأ أَبُو الْحَسَنِ مُحَمَّدُ بْنُ عَبْدِ اللهِ بْنِ إِبْرَاهِيمَ بْنِ عَبْدَةَ ثنا أَبُو عَبْدِ اللهِ مُحَمَّدُ بْنُ إِبْرَاهِيمَ الْبُوشَنْجِيُّ ثنا أَحْمَدُ بْنُ حَنْبَلٍ ثنا حَفْصُ بْنُ غِيَاثٍ ثنا عُبَيْدُ اللهِ بْنُ عُمَرَ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ قَالَ لَيْسَ فِي الْعُرُوضِ زَكَاةٌ إِلَّا مَا كَانَ لِلتِّجَارَةِ قَالَ الشَّيْخُ وَهَذَا قَوْلُ عَامَّةِ أَهْلِ الْعِلْمِ فَالَّذِي رُوِيَ عَنِ ابْنِ عَبَّاسٍ ؓ أَنَّهُ قَالَ لَا زَكَاةَ فِي الْعَرَضِ فَقَدْ قَالَ الشَّافِعِيُّ فِي كِتَابِ الْقَدْيمِ إِسْنَادُ الْحَدِيثِ عَنِ ابْنِ عَبَّاسٍ ضَعِيفٌ فَكَانَ اتِّبَاعُ حَدِيثِ ابْنِ عُمَرَ لِصِحَّتِهِ وَالِاحْتِيَاطِ فِي الزَّكَاةِ أَحَبُّ إِلَيَّ وَاللهُ أَعْلَمُ قَالَ الشَّيْخُ وَقَدْ حَكَى ابْنُ الْمُنْذِرِ عَنْ عَائِشَةَ وَابْنِ عَبَّاسٍ مِثْلَ مَا رُوِّينَا عَنِ ابْنِ عُمَرَ وَلَمْ يُحْكَ خِلَافُهُمْ عَنْ أَحَدٍ فَيُحْتَمَلُ أَنْ يَكُونَ مَعْنَى قَوْلِهِ إِنْ صَحَّ لَا زَكَاةَ فِي الْعَرَضِ أَيْ إِذَا لَمْ يُرَدْ بِهِ التِّجَارَةُ
انگریزی ترجمہ
Abu Nasr Umar ibn Abd al-Aziz informed us from his book... from Ibn Umar who said: 'There is no zakah on goods except what is intended for trade.' The Shaykh said: This is the position of the majority of scholars. As for what is narrated from Ibn Abbas (may Allah be pleased with him) that he said there is no zakah on goods, al-Shafi'i said in his old book: The chain of narration from Ibn Abbas is weak. So following the hadith of Ibn Umar due to its authenticity and being cautious regarding zakah is more beloved to me. And Allah knows best. The Shaykh said: Ibn al-Mundhir reported from Aishah and Ibn Abbas similar to what we narrated from Ibn Umar, and no disagreement from them was reported from anyone. So it is possible that the meaning of his saying, if it is authentic, 'there is no zakah on goods' means: when they are not intended for trade.
