وَأَخْبَرَنَا أَبُو سَعِيدٍ ثنا أَبُو الْعَبَّاسِ ثنا الْحَسَنُ ثنا يَحْيَى بْنُ آدَمَ ثنا حَاتِمُ بْنُ إِسْمَاعِيلَ عَنْ جَعْفَرِ بْنِ مُحَمَّدٍ عَنْ أَبِيهِ قَالَ فَرَضَ رَسُولُ اللهِ ﷺ فِيمَا سَقَتِ السَّمَاءُ أَوْ سُقِيَ بِالسَّيْلِ وَالْغَيْلِ وَالْبَعْلِ الْعُشْرُ وَمَا سُقِيَ بِالنَّوَاضِحِ فَنِصْفُ الْعُشْرِ قَالَ حَاتِمٌ الْغَيْلُ مَا سُقِيَ فَتْحًا وَالْبَعْلُ هُوَ الْعَذْيُ الَّذِي يَسْقِيَهِ مَاءُ الْمَطَرِ قَالَ يَحْيَى بْنُ آدَمَ وَسَأَلْتُ أَبَا إِيَاسٍ يَعْنِي الْأَسَدِيَّ فَقَالَ الْبَعْلُ وَالْعَثَرِيُّ وَالْعَذْيُ هُوَ الَّذِي يُسْقَى بِمَاءِ السَّمَاءِ قَالَ يَحْيَى الْعَثَرِيُّ مَا يُزْرَعُ لِلْسَحَابِ لِلْمَطَرِ خَاصَّةً لَيْسَ يُسْقَى إِلَّا بِمَاءٍ يُصِيبُهُ مِنَ الْمَطَرِ فَذَلِكَ الْعَثَرِيُّ وَالْبَعْلُ مَا كَانَ مِنَ الْكُرُومِ قَدْ ذَهَبَتْ عُرُوقُهُ فِي الْأَرْضِ إِلَى الْمَاءِ فَلَا يَحْتَاجُ إِلَى السَّقْيِ الْخَمْسَ السِّنِينَ وَالسِّتَّ يَحْتَمِلُ تَرْكَ السَّقْيِ فَهَذَا الْبَعْلُ وَالسَّيْلُ مَاءُ الْوَادِي إِذَا سَالَ وَأَمَّا الْغَيْلُ فَهُوَ سَيْلٌ دُونَ السَّيْلِ الْكَثِيرِ إِذَا سَالَ الْقَلِيلُ بِالْمَاءِ الصَّافِي فَهُوَ الْغَيْلُ وَالْعَذْيُ مَاءُ الْمَطَرِ
انگریزی ترجمہ
Abu Sa'id narrated to us: Abu al-Abbas narrated to us: al-Hasan narrated to us: Yahya ibn Adam narrated to us: Hatim ibn Isma'il narrated from Ja'far ibn Muhammad, from his father, who said: The Messenger of Allah (peace be upon him) prescribed for what the sky watered, or was irrigated by flood waters, spring waters, or rain-fed crops, one-tenth; and what was irrigated by water-drawing camels, half of one-tenth. Hatim said: al-Ghayl is what is irrigated by natural flow. al-Ba'l is rain-fed crops watered by rainwater. Yahya ibn Adam said: I asked Abu Iyas - meaning al-Asadi - and he said: al-Ba'l, al-'Atheri, and al-'Adhi are what is watered by rainwater. Yahya said: al-'Atheri is what is planted solely for rain, not irrigated except by rainwater it receives, that is al-'Atheri. al-Ba'l is grapevines whose roots have gone deep into the ground to reach water, so they do not need watering for five or six years; they can withstand lack of irrigation, that is al-Ba'l. al-Sayl is wadi water when it flows. As for al-Ghayl, it is a flow less than a large flood, when a small amount of clear water flows, that is al-Ghayl. al-'Adhi is rainwater.
