وَأَخْبَرَنَا أَبُو طَاهِرٍ الْفَقِيهُ مِنْ أَصْلِ كِتَابِهِ أنبأ أَبُو عُثْمَانَ عَمْرُو بْنُ عَبْدِ اللهِ الْبَصْرِيُّ ثنا مُحَمَّدُ بْنُ عَبْدِ الْوَهَّابِ أنبأ يَعْلَى بْنُ عُبَيْدٍ ثنا سُفْيَانُ عَنْ أَبِي الْعَلَاءِ عَنْ مَكْحُولٍ قَالَ قَالَ رَسُولُ اللهِ ﷺ إِنَّ أَعْجَلَ الْخَيْرِ ثَوَابًا صِلَةُ الرَّحِمِ وَإِنَّ أَعْجَلَ الشَّرِّ عُقُوبَةً الْبَغْيُ وَالْيَمِينُ الصَّبْرُ الْفَاجِرَةُ تَدَعُ الدِّيَارَ بَلَاقِعَ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ مَنْ حَلَفَ عَامِدًا لِلْكَذِبِ فَقَالَ وَاللهِ لَقَدْ كَانَ كَذَا وَكَذَا وَلَمْ يَكُنْ كَفَّرَ وَقَدْ أَثِمَ وَأَسَاءَ حَيْثُ عَمَدَ الْحَلِفَ بِاللهِ بَاطِلًا قَالَ الشَّافِعِيُّ فَإِنْ قَالَ وَمَا الْحُجَّةُ فِي أَنْ يُكَفِّرَ وَقَدْ عَمَدَ الْبَاطِلَ؟ قِيلَ أَقْرَبُهَا قَوْلُ النَّبِيِّ ﷺ فَلْيَأْتِ الَّذِي هُوَ خَيْرٌ وَلْيُكَفِّرْ عَنْ يَمِينِهِ فَقَدْ أَمَرَهُ أَنْ يَعْمَدَ الْحِنْثَ
انگریزی ترجمہ
Makhul reported that the Messenger of Allah (peace and blessings be upon him) said: The good deed most quickly rewarded is maintaining ties of kinship, and the evil most quickly punished is transgression. A deliberate false oath leaves homes desolate. Al-Shafi'i (may Allah have mercy on him) said: Whoever swears deliberately to a lie, saying 'By Allah, such and such happened' when it did not, must make expiation, and he has sinned and done wrong by deliberately swearing falsely by Allah. Al-Shafi'i said: If one asks, 'What is the proof that he should make expiation when he deliberately swore falsely?' The answer is: The closest evidence is the Prophet's (peace and blessings be upon him) statement: 'Let him do that which is better and make expiation for his oath,' for he commanded him to deliberately break his oath.
