أَنَّ النَّبِيَّ ﷺ قَالَ مَنْ دَخَلَ حَائِطًا فَلْيَأْكُلْ وَلَا يَتَّخِذْ خُبْنَةً أَخْبَرَنَاهُ عُمَرُ بْنُ أَحْمَدَ أنبأ أَبُو عَمْرٍو السُّلَمِيُّ ثنا أَبُو جَعْفَرٍ مُحَمَّدُ بْنُ مُوسَى الْحُلْوَانِيُّ ثنا مُحَمَّدُ بْنُ مَنْصُورٍ الْجَوَّازُ الْمَكِّيُّ ثنا يَحْيَى بْنُ سُلَيْمٍ فَذَكَرَهُ 19652 وَقَدْ أَخْبَرَنَا أَبُو مُحَمَّدٍ السُّكَّرِيُّ أَنْبَأَ أَبُو بَكْرٍ الشَّافِعِيُّ ثنا جَعْفَرُ بْنُ مُحَمَّدِ بْنِ الْأَزْهَرِ ثنا الْمُفَضَّلُ بْنُ غَسَّانَ قَالَ وَذُكِرَ لِأَبِي زَكَرِيَّا يَحْيَى بْنِ مَعِينٍ حَدِيثُ يَحْيَى بْنِ سُلَيْمٍ الطَّائِفِيِّ عَنْ عُبَيْدِ اللهِ فِي الرَّجُلِ يَمُرُّ بِالْحَائِطِ فَيَأْكُلُ مِنْهُ قَالَ هَذَا غَلَطٌ وَقَالَ أَبُو عِيسَى التِّرْمِذِيُّ سَأَلْتُ مُحَمَّدَ بْنَ إِسْمَاعِيلَ عَنْ هَذَا الْحَدِيثِ فَقَالَ يَحْيَى بْنُ سُلَيْمٍ يَرْوِي أَحَادِيثَ عَنْ عُبَيْدِ اللهِ يَهِمُ فِيهَا قَالَ الشَّيْخُ وَقَدْ رُوِيَ مِنْ أَوْجُهٍ أُخَرَ لَيْسَتْ بِقَوِيَّةٍ البيهقي ١٩٦٥١: عن

That the Prophet (peace and blessings be upon him) said: "Whoever enters a walled garden, let him eat but not take a bundle away." Umar ibn Ahmad informed us of it: Abu Amr al-Sulami reported to us: Abu Ja'far Muhammad ibn Musa al-Hulwani narrated to us: Muhammad ibn Mansur al-Jawwaz al-Makki narrated to us: Yahya ibn Sulaym narrated to us — and he mentioned it. [19652] And Abu Muhammad al-Sukkari informed us: Abu Bakr al-Shafi'i reported to us: Ja'far ibn Muhammad ibn al-Azhar narrated to us: al-Mufaddal ibn Ghassan narrated to us; he said: The hadith of Yahya ibn Sulaym al-Ta'ifi, from Ubaydullah, concerning the man who passes by a walled garden and eats from it, was mentioned to Abu Zakariyya Yahya ibn Ma'in, and he said: "This is an error." And Abu Isa al-Tirmidhi said: I asked Muhammad ibn Isma'il [al-Bukhari] about this hadith, and he said: "Yahya ibn Sulaym narrates hadiths from Ubaydullah in which he errs."
