أَخْبَرَنَا أَبُو عَبْدِ الرَّحْمَنِ السُّلَمِيُّ ثنا أَبُو الْحَسَنِ الْكَارِزِيُّ ثنا عَلِيُّ بْنُ عَبْدِ الْعَزِيزِ عَنْ أَبِي عُبَيْدٍ ثنا مَرْوَانُ بْنُ مُعَاوِيَةَ عَنْ هِشَامٍ الدَّسْتُوَائِيِّ وَحَجَّاجِ بْنِ أَبِي عُثْمَانَ عَنْ يَحْيَى بْنِ أَبِي كَثِيرٍ عَنِ الْمَعْرُورِ الْكَلْبِيِّ عَنْ عُمَرَ ؓ أَنَّهُ نَهَى عَنِ الْفَرْسِ فِي الذَّبِيحَةِ قَالَ أَبُو عُبَيْدٍ قَالَ أَبُو عُبَيْدَةَ الْفَرْسُ هُوَ النَّخْعُ يُقَالُ مِنْهُ فَرَسْتُ الشَّاةَ وَنَخَعْتُهَا وَذَلِكَ أَنْ يَنْتَهِيَ بِالذَّبْحِ إِلَى النُّخَاعِ وَهُوَ عَظْمٌ فِي الرَّقَبَةِ وَيُقَالُ أَيْضًا بَلْ هُوَ الَّذِي يَكُونُ فِي فَقَارِ الصُّلْبِ شَبِيهٌ بِالْمُخِّ وَهُوَ مُتَّصِلٌ بِالْقَفَا يَقُولُ فَنَهَى أَنْ يَنْتَهِيَ بِالذَّبْحِ إِلَى ذَلِكَ قَالَ أَبُو عُبَيْدٍ أَمَّا النَّخْعُ فَهُوَ عَلَى مَا قَالَ أَبُو عُبَيْدَةَ وَأَمَّا الْفَرْسُ فَقَدْ خُولِفَ فِيهِ يُقَالُ هُوَ الْكَسْرُ وَإِنَّمَا نَهَى أَنْ يَكْسِرَ رَقَبَةَ الذَّبِيحَةِ قَبْلَ أَنْ تَبْرُدَ وَمِمَّا يُبَيِّنُ ذَلِكَ أَنَّ فِي الْحَدِيثِ وَلَا تَعْجَلُوا الْأَنْفُسَ حَتَّى تَزْهَقَ

Abu Abd al-Rahman al-Sulami informed us, Abu al-Hasan al-Karizi informed us, Ali ibn Abd al-Aziz narrated to us from Abu Ubayd, Marwan ibn Mu'awiyah narrated to us from Hisham al-Dastawa'i and Hajjaj ibn Abi Uthman from Yahya ibn Abi Kathir from al-Ma'rur al-Kalbi from Umar (may Allah be pleased with him) that he prohibited fars (breaking the neck) in slaughter. Abu Ubayd said: Abu Ubaydah said: Fars is the same as nakh'. One says: "I performed fars on the sheep" and "I performed nakh' on it." That is when the slaughter reaches the spinal marrow, which is a bone in the neck. It is also said that it is what is in the vertebrae of the spine, resembling marrow, connected to the back of the head. He means: He prohibited extending the slaughter to that point. Abu Ubayd said: As for nakh', it is as Abu Ubaydah said. As for fars, there is disagreement about it. It is said to mean breaking, and the prohibition is against breaking the neck of the slaughtered animal before it cools. What clarifies this is the statement in the hadith: "Do not hasten the souls until they depart."
