وَأَخْبَرَنَا أَبُو سَعِيدٍ ثنا أَبُو الْعَبَّاسِ ثنا الْحَسَنُ ثنا يَحْيَى ثنا عَبْدُ السَّلَامِ بْنُ حَرْبٍ عَنْ أَبِي إِسْحَاقَ عَنِ السَّفَّاحِ عَنْ دَاوُدَ بْنِ كُرْدُوسٍ عَنْ عُبَادَةَ بْنِ النُّعْمَانِ التَّغْلِبِيِّ أَنَّهُ قَالَ لِعُمَرَ بْنِ الْخَطَّابِ ؓ يَا أَمِيرَ الْمُؤْمِنِينَ إِنَّ بَنِي تَغْلِبَ مَنْ قَدْ عَلِمْتَ شَوْكَتَهُمْ وَإِنَّهُمْ بِإِزَاءِ الْعَدُوِّ فَإِنْ ظَاهَرُوا عَلَيْكَ الْعَدُوَّ اشْتَدَّتْ مُؤْنَتُهُمْ فَإِنْ رَأَيْتَ أَنْ تُعْطِيَهُمْ شَيْئًا قَالَ فَافْعَلْ قَالَ فَصَالَحَهُمْ عَلَى أَنْ لَا يَغْمِسُوا أَحَدًا مِنْ أَوْلَادِهِمْ فِي النَّصْرَانِيَّةِ وَتُضَاعَفَ عَلَيْهِمُ الصَّدَقَةُ قَالَ وَكَانَ عُبَادَةُ يَقُولُ قَدْ فَعَلُوا وَلَا عَهْدَ لَهُمْ 18797 أَخْبَرَنَا أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو ثنا أَبُو الْعَبَّاسِ أَنْبَأَ الرَّبِيعُ قَالَ قَالَ الشَّافِعِيُّ عُقَيْبَ هَذَا الْحَدِيثِ وَهَكَذَا حَفِظَ أَهْلُ الْمَغَازِي وَسَاقُوهُ أَحْسَنَ مِنْ هَذَا السِّيَاقِ فَقَالُوا رَامَهُمْ عَلَى الْجِزْيَةِ فَقَالُوا نَحْنُ عَرَبٌ لَا نُؤَدِّي مَا يُؤَدِّي الْعَجَمُ وَلَكِنْ خُذْ مِنَّا كَمَا يَأْخُذُ بَعْضُكُمْ مِنْ بَعْضٍ يَعْنُونَ الصَّدَقَةَ فَقَالَ عُمَرُ ؓ لَا هَذَا فَرْضٌ عَلَى الْمُسْلِمِينَ فَقَالُوا فَزِدْ مَا شِئْتَ بِهَذَا الِاسْمِ لَا بِاسْمِ الْجِزْيَةِ فَفَعَلَ فَتَرَاضَى هُوَ وَهُمْ عَلَى أَنْ ضَعَّفَ عَلَيْهِمُ الصَّدَقَةَ
انگریزی ترجمہ
Ubadah ibn al-Nu'man al-Taghlibi said to Umar ibn al-Khattab (may Allah be pleased with him): O Commander of the Faithful, Banu Taghlib are a people whose military strength you know, and they are on the frontline facing the enemy. If they ally with the enemy against you, their burden will be severe. If you see fit, give them something. Umar said: Do so. So he made a treaty with them that they would not baptize any of their children into Christianity, and the charity upon them would be doubled. Ubadah used to say: They have done so (baptized) and they have no covenant. Al-Shafi'i said after this hadith: This is what the historians have preserved, and they narrated it better than this narration. They said he demanded the jizya from them, and they said: We are Arabs, we do not pay what the non-Arabs pay, but take from us as you take from one another, meaning the charity. Umar said: No, this is an obligation upon the Muslims. They said: Increase it as you wish by that name, not by the name of jizya. So he did, and they agreed that he doubled the charity upon them.
