أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ وَأَبُو صَادِقٍ مُحَمَّدُ بْنُ أَبِي الْفَوَارِسِ الصَّيْدَلَانِيُّ قَالَا نا أَبُو الْعَبَّاسِ هُوَ الْأَصَمُّ نا الْحَسَنُ بْنُ عَلِيِّ بْنِ عَفَّانَ نا مُحَمَّدُ بْنُ بِشْرٍ الْعَبْدِيُّ نا سَعِيدٌ هُوَ ابْنُ أَبِي عَرُوبَةَ عَنْ قَتَادَةَ عَنِ الْحَسَنِ فِي هَذِهِ الْآيَةِ {فَابْعَثُوا حَكَمًا مِنْ أَهْلِهِ وَحَكَمًا مِنْ أَهْلِهَا} [النساء 35] قَالَ إِنَّمَا عَلَيْهِمَا أَنْ يُصْلِحَا وَأَنْ يَنْظُرَا فِي ذَلِكَ وَلَيْسَ الْفُرْقَةُ فِي أَيْدِيهِمَا هَذَا خِلَافُ مَا مَضَى وَهُوَ أَصَحُّ قَوْلِ الشَّافِعِيِّ رَحِمَهُ اللهُ وَعَلَيْهِ يَدُلُّ ظَاهِرُ مَا رُوِّينَا عَنْ عَلِيٍّ ؓ إِلَّا أَنْ يَجْعَلَاهَا إِلَيْهِمَا وَاللهُ أَعْلَمُ
انگریزی ترجمہ
Abu 'Abdullah al-Hafiz and Abu Sadiq Muhammad ibn Abi al-Fawaris al-Saydalani reported to us... from Qatadah from al-Hasan regarding the verse {Send an arbiter from his family and an arbiter from her family} [An-Nisa 35]. He said: Their role is only to reconcile and look into the matter, and separation is not in their hands. This is contrary to what has preceded, and it is the most correct opinion of al-Shafi'i, may Allah have mercy on him. The apparent meaning of what we narrated from Ali (may Allah be pleased with him) supports this, unless the couple delegate that authority to them. And Allah knows best.
