أَخْبَرَنَا أَبُو نَصْرِ بْنُ قَتَادَةَ أنبأ أَبُو مَنْصُورٍ الْعَبَّاسُ بْنُ الْفَضْلِ الْهَرَوِيُّ أنبأ أَحْمَدُ بْنُ نَجْدَةَ ثنا سَعِيدُ بْنُ مَنْصُورٍ ثنا جَرِيرٌ عَنْ مُغِيرَةَ عَنِ الشَّعْبِيِّ قَالَ تَزَوَّجَ رَجُلٌ مِنَّا امْرَأَةً فَطَلَّقَهَا زَوْجُهَا قَبْلَ أَنْ يَدْخُلَ بِهَا فَعَفَا أَخُوهَا عَنْ صَدَاقِهَا فَارْتَفَعُوا إِلَى شُرَيْحٍ فَأَجَازَ عَفْوَهُ ثُمَّ قَالَ بَعْدُ أَنَا أَعْفُو عَنْ صَدَاقِ بَنِيَّ مَرَّةً فَكَانَ يَقُولُ بَعْدَ الَّذِي بِيَدِهِ عُقْدَةُ النِّكَاحِ الزَّوْجُ أَنْ يَعْفُوَ عَنِ الصَّدَاقِ كُلِّهِ فَيُسَلِّمَهُ إِلَيْهَا أَوْ تَعْفُوَ هِيَ عَنِ النِّصْفِ الَّذِي فَرَضَ اللهُ لَهَا وَإِنْ تَشَاحَّا فَلَهَا نِصْفُ الصَّدَاقِ 14452 وَبِهَذَا الْإِسْنَادِ عَنِ الشَّعْبِيِّ قَالَ وَاللهِ مَا قَضَى شُرَيْحٌ قَضَاءً قَطُّ كَانَ أَحْمَقَ مِنْهُ حِينَ تَرَكَ قَوْلَهُ الْأَوَّلَ وَأَخَذَ بِهَذَا
انگریزی ترجمہ
Al-Sha'bi said: A man among us married a woman, and her husband divorced her before consummation. Her brother forgave the dowry. They went to Shurayh who approved his forgiveness. Then Shurayh said afterwards: I will forgive the dowry of my daughters once. After that he would say: 'The one in whose hand is the marriage tie is the husband - that he forgives the entire dowry and gives it all to her, or she forgives the half that Allah prescribed for her. And if they dispute, then she gets half the dowry.' Al-Sha'bi said: By Allah, Shurayh never made a more foolish ruling than when he abandoned his first view and took this one.
