أَخْبَرَنَا أَبُو أَحْمَدَ الْمِهْرَجَانِيُّ أنا أَبُو بَكْرٍ مُحَمَّدُ بْنُ جَعْفَرٍ الْمُزَكِّي ثنا مُحَمَّدُ بْنُ إِبْرَاهِيمَ حَدَّثَنَا ابْنُ بُكَيْرٍ ثنا مَالِكٌ عَنْ عَبْدِ اللهِ بْنِ أَبِي بَكْرٍ عَنْ أَبِيهِ أَنَّ عَمْرَو بْنَ سُلَيْمٍ الزُّرَقِيَّ أَخْبَرَهُ أَنَّهُ قِيلَ لِعُمَرَ بْنِ الْخَطَّابِ ؓ إِنَّ هَا هُنَا غُلَامًا يَفَاعًا لَمْ يَحْتَلِمْ مِنْ غَسَّانَ وَوَارِثُهُ بِالشَّامِ وَهُوَ ذُو مَالٍ وَلَيْسَ لَهُ هَا هُنَا إِلَّا ابْنَةُ عَمٍّ لَهُ فَقَالَ عُمَرُ بْنُ الْخَطَّابِ ؓ فَلْيُوصِ لَهَا فَأَوْصَى لَهَا بِمَالٍ يُقَالُ لَهُ بِئْرُ جُشَمَ قَالَ عَمْرُو بْنُ سُلَيْمٍ فَبِعْتُ ذَلِكَ الْمَالَ بِثَلَاثِينَ أَلْفًا وَابْنَةُ عَمِّهِ الَّتِي أَوْصَى لَهَا هِيَ أُمُّ عَمْرِو بْنُ سُلَيْمٍ وَيُذْكَرُ عَنْ شُرَيْحٍ وَعَبْدِ اللهِ بْنِ عُتْبَةَ أَنَّهُمَا أَجَازَا وَصِيَّةَ الصَّغِيرِ وَقَالَا مَنْ أَصَابَ الْحَقَّ أَجَزْنَاهُ وَالشَّافِعِيُّ رَحِمَهُ اللهُ عَلَّقَ جَوَازَ وَصِيَّتِهِ وَتَدْبِيرِهِ بِثِبُوتِ الْخَبَرِ فِيهَا عَنْ عُمَرَ ؓ وَالْخَبَرُ مُنْقَطِعٌ؛ فَعَمْرُو بْنُ سُلَيْمٍ الزُّرَقِيُّ لَمْ يُدْرِكْ عُمَرَ ؓ إِلَّا أَنَّهُ ذَكَرَ فِي الْخَبَرِ انْتِسَابَهُ إِلَى صَاحِبِ الْقِصَّةِ وَاللهُ أَعْلَمُ
انگریزی ترجمہ
Amr ibn Sulaym al-Zuraqi reported that it was said to Umar ibn al-Khattab (may Allah be pleased with him): 'There is here a young boy who has not yet reached puberty, from Ghassan, whose heir is in Sham. He has wealth but has no one here except a female cousin.' Umar ibn al-Khattab said: 'Let him make a bequest to her.' So he bequeathed to her some property called Bi'r Jusham. Amr ibn Sulaym said: 'I sold that property for thirty thousand.' The female cousin to whom he bequeathed is the mother of Amr ibn Sulaym. It is mentioned from Shurayh and Abdullah ibn Utbah that they approved the bequest of a minor and said: 'Whoever makes a correct decision, we approve it.' Al-Shafi'i made the permissibility of his bequest and tadbir contingent upon establishing the report in it from Umar, but the report is disconnected, as Amr ibn Sulaym al-Zuraqi did not meet Umar, except that he mentioned in the report his connection to the person in the story.
