أَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنا عَبْدُ اللهِ بْنُ عُمَرَ بْنِ أَحْمَدَ بْنِ شَوْذَبٍ الْمُقْرِئُ بِوَاسِطَ ثنا شُعَيْبُ بْنُ أَيُّوبَ ثنا مُعَاوِيَةُ بْنُ هِشَامٍ عَنْ سُفْيَانَ عَنْ أَبِي إِسْحَاقَ عَنِ الْحَارِثِ عَنْ عَلِيٍّ قَالَ قَضَى رَسُولُ اللهِ ﷺ أَنَّ الدَّيْنَ قَبْلَ الْوَصِيَّةِ وَأَنْتُمْ تَقْرَءُونَهَا {مِنْ بَعْدِ وَصِيَّةٍ يُوصَى بِهَا أَوْ دَيْنٍ} [النساء 12] وإِنَّ أَعْيَانَ بَنِي الْأُمِّ يَتَوَارَثُونَ دُونَ بَنِي الْعَلَّاتِ يَرِثُ الرَّجُلُ أَخَاهُ لِأَبِيهِ وَأُمِّهِ دُونَ إِخْوَتِهِ لِأَبِيهِ

Abu Sa'id informed us: Abu Abdullah narrated to us: Muhammad ibn Nasr narrated to us: Muhammad ibn Yahya narrated to us: Sa'id ibn Abi Maryam narrated to us: Abd al-Rahman ibn Abi al-Zinad narrated from his father from Kharijah ibn Zayd from his father Zayd ibn Thabit that in this case with a husband, mother, and maternal siblings where no full siblings share: Zayd gave the husband one-half, the mother one-sixth, and the maternal siblings one-third, with no share for the full siblings.
