حَدَّثَنَا يَعْقُوبُ حَدَّثَنَا أَبِي عَنْ مُحَمَّدِ بْنِ إِسْحَاقَ فَذَكَرَ حَدِيثًا قَالَ ابْنُ إِسْحَاقَ وَذَكَرَ عَمْرُو بْنُ شُعَيْبِ بْنِ مُحَمَّدِ بْنِ عَبْدِ اللَّهِ بْنِ عَمْرِو بْنِ الْعَاصِ عَنْ أَبِيهِ عَنْ جَدِّهِ قَالَ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مَنْ قَتَلَ مُؤْمِنًا مُتَعَمِّدًا فَإِنَّهُ يُدْفَعُ إِلَى أَوْلِيَاءِ الْقَتِيلِ فَإِنْ شَاءُوا قَتَلُوا وَإِنْ شَاءُوا أَخَذُوا الدِّيَةَ وَهِيَ ثَلَاثُونَ حِقَّةً وَثَلَاثُونَ جَذَعَةً وَأَرْبَعُونَ خَلِفَةً فَذَلِكَ عَقْلُ الْعَمْدِ وَمَا صَالَحُوا عَلَيْهِ مِنْ شَيْءٍ فَهُوَ لَهُمْ وَذَلِكَ شَدِيدُ الْعَقْلِ وَعَقْلُ شِبْهِ الْعَمْدِ مُغَلَّظَةٌ مِثْلُ عَقْلِ الْعَمْدِ وَلَا يُقْتَلُ صَاحِبُهُ وَذَلِكَ أَنْ يَنْزِغَ الشَّيْطَانُ بَيْنَ النَّاسِ فَتَكُونَ دِمَاءٌ فِي غَيْرِ ضَغِينَةٍ وَلَا حَمْلِ سِلَاحٍ فَإِنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ يَعْنِي مَنْ حَمَلَ عَلَيْنَا السِّلَاحَ فَلَيْسَ مِنَّا وَلَا رَصَدَ بِطَرِيقٍ فَمَنْ قُتِلَ عَلَى غَيْرِ ذَلِكَ فَهُوَ شِبْهُ الْعَمْدِ وَعَقْلُهُ مُغَلَّظَةٌ وَلَا يُقْتَلُ صَاحِبُهُ وَهُوَ بِالشَّهْرِ الْحَرَامِ وَلِلْحُرْمَةِ وَلِلْجَارِ وَمَنْ قُتِلَ خَطَأً فَدِيَتُهُ مِائَةٌ مِنْ الْإِبِلِ ثَلَاثُونَ ابْنَةُ مَخَاضٍ وَثَلَاثُونَ ابْنَةُ لَبُونٍ وَثَلَاثُونَ حِقَّةٌ وَعَشْرُ بَكَارَةٍ بَنِي لَبُونٍ ذُكُورٍ قَالَ وَكَانَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يُقِيمُهَا عَلَى أَهْلِ الْقُرَى أَرْبَعَ مِائَةِ دِينَارٍ أَوْ عِدْلَهَا مِنْ الْوَرِقِ وَكَانَ يُقِيمُهَا عَلَى أَثْمَانِ الْإِبِلِ فَإِذَا غَلَتْ رَفَعَ فِي قِيمَتِهَا وَإِذَا هَانَتْ نَقَصَ مِنْ قِيمَتِهَا عَلَى عَهْدِ الزَّمَانِ مَا كَانَ فَبَلَغَتْ عَلَى عَهْدِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مَا بَيْنَ أَرْبَعِ مِائَةِ دِينَارٍ إِلَى ثَمَانِ مِائَةِ دِينَارٍ وَعِدْلُهَا مِنْ الْوَرِقِ ثَمَانِيَةُ آلَافِ دِرْهَمٍ وَقَضَى أَنَّ مَنْ كَانَ عَقْلُهُ عَلَى أَهْلِ الْبَقَرِ فِي الْبَقَرِ مِائَتَيْ بَقَرَةٍ وَقَضَى أَنَّ مَنْ كَانَ عَقْلُهُ عَلَى أَهْلِ الشَّاءِ فَأَلْفَيْ شَاةٍ وَقَضَى فِي الْأَنْفِ إِذَا جُدِعَ كُلُّهُ بِالْعَقْلِ كَامِلًا وَإِذَا جُدِعَتْ أَرْنَبَتُهُ فَنِصْفُ الْعَقْلِ وَقَضَى فِي الْعَيْنِ نِصْفَ الْعَقْلِ خَمْسِينَ مِنْ الْإِبِلِ أَوْ عِدْلَهَا ذَهَبًا أَوْ وَرِقًا أَوْ مِائَةَ بَقَرَةٍ أَوْ أَلْفَ شَاةٍ وَالرِّجْلُ نِصْفُ الْعَقْلِ وَالْيَدُ نِصْفُ الْعَقْلِ وَالْمَأْمُومَةُ ثُلُثُ الْعَقْلِ ثَلَاثٌ وَثَلَاثُونَ مِنْ الْإِبِلِ أَوْ قِيمَتُهَا مِنْ الذَّهَبِ أَوْ الْوَرِقِ أَوْ الْبَقَرِ أَوْ الشَّاءِ وَالْجَائِفَةُ ثُلُثُ الْعَقْلِ وَالْمُنَقِّلَةُ خَمْسَ عَشْرَةَ مِنْ الْإِبِلِ وَالْمُوضِحَةُ خَمْسٌ مِنْ الْإِبِلِ وَالْأَسْنَانُ خَمْسٌ مِنْ الْإِبِلِ قَالَ وَذَكَرَ عَمْرُو بْنُ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ قَالَ قَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي رَجُلٍ طَعَنَ رَجُلًا بِقَرْنٍ فِي رِجْلِهِ فَقَالَ يَا رَسُولَ اللَّهِ أَقِدْنِي فَقَالَ لَهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لَا تَعْجَلْ حَتَّى يَبْرَأَ جُرْحُكَ قَالَ فَأَبَى الرَّجُلُ إِلَّا أَنْ يَسْتَقِيدَ فَأَقَادَهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مِنْهُ قَالَ فَعَرِجَ الْمُسْتَقِيدُ وَبَرَأَ الْمُسْتَقَادُ مِنْهُ فَأَتَى الْمُسْتَقِيدُ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ لَهُ يَا رَسُولَ اللَّهِ عَرِجْتُ وَبَرَأَ صَاحِبِي فَقَالَ لَهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَلَمْ آمُرْكَ أَلَّا تَسْتَقِيدَ حَتَّى يَبْرَأَ جُرْحُكَ فَعَصَيْتَنِي فَأَبْعَدَكَ اللَّهُ وَبَطَلَ جُرْحُكَ ثُمَّ أَمَرَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بَعْدَ الرَّجُلِ الَّذِي عَرِجَ مَنْ كَانَ بِهِ جُرْحٌ أَنْ لَا يَسْتَقِيدَ حَتَّى تَبْرَأَ جِرَاحَتُهُ فَإِذَا بَرِئَتْ جِرَاحَتُهُ اسْتَقَادَ.

Ya'qub told us: my father told us, from Muhammad ibn Ishaq, who related a hadith - Ibn Ishaq said: Amr ibn Shu'ayb ibn Muhammad ibn Abdullah ibn Amr ibn al-As mentioned, from his father, from his grandfather, who said: The Messenger of Allah, peace and blessings be upon him, said: Whoever kills a believer intentionally is handed over to the heirs of the slain; if they wish they may kill him, and if they wish they may take the blood-money, which is thirty hiqqahs, thirty jadha'ahs, and forty pregnant she-camels - that is the compensation for intentional killing, and whatever they settle for beyond that is theirs, and that is a harsher compensation. The compensation for quasi-intentional killing is likewise heavy, like that for intentional killing, but its perpetrator is not killed - that is when Satan stirs up trouble among people so that blood is shed without malice or the carrying of weapons, for the Messenger of Allah, peace and blessings be upon him, said - meaning: whoever carries weapons against us is not of us - nor lying in ambush on the road. Whoever is killed other than in that manner, it is quasi-intentional and its compensation is heavy, and its perpetrator is not killed; and that applies during the sacred month, and for sanctity, and for a neighbor. Whoever is killed by mistake, his blood-money is a hundred camels: thirty daughters of makhad, thirty daughters of labun, thirty hiqqahs, and ten young male camels of the labun age. He said: The Messenger of Allah, peace and blessings be upon him, used to assess it upon the people of the villages at four hundred dinars or its equivalent in silver, and he used to assess it according to the price of camels; when they became expensive he raised its value, and when they became cheap he lowered its value, according to the time. It reached, in the time of the Messenger of Allah, peace and blessings be upon him, between four hundred and eight hundred dinars, its equivalent in silver being eight thousand dirhams. And he ruled that whoever's compensation was assessed upon the people of cattle should be two hundred cows, and whoever's was assessed upon the people of sheep should be two thousand sheep. And he ruled concerning the nose, that if the whole of it is cut off, full compensation is due, and if only its tip is cut off, half compensation is due. And he ruled concerning the eye, half compensation - fifty camels, or its equivalent in gold or silver, or a hundred cows, or a thousand sheep; the leg is half compensation, the hand is half compensation; the head-wound reaching the brain membrane is a third of the compensation - thirty-three camels or their value in gold, silver, cattle, or sheep; the wound penetrating to the body cavity is a third of the compensation; the wound displacing bone is fifteen camels; the wound exposing the bone is five camels; and the teeth are five camels each. He said: Amr ibn Shu'ayb also mentioned, from his father, from his grandfather, who said: The Messenger of Allah, peace and blessings be upon him, ruled in the case of a man who stabbed another man's leg with a horn. The man said: O Messenger of Allah, let me retaliate. The Messenger of Allah, peace and blessings be upon him, said to him: Do not be hasty, wait until your wound heals. But the man refused anything but to retaliate at once, so the Messenger of Allah, peace and blessings be upon him, had him retaliate against the offender. He said: Then the one who had retaliated became lame, while the one against whom he retaliated healed completely. So the one who had retaliated came to the Messenger of Allah, peace and blessings be upon him, and said: O Messenger of Allah, I have become lame while my companion has healed. The Messenger of Allah, peace and blessings be upon him, said to him: Did I not command you not to retaliate until your wound healed? You disobeyed me, so may Allah keep you far off, and your wound is void. Then, after that man who became lame, the Messenger of Allah, peace and blessings be upon him, commanded that whoever has a wound should not retaliate until his wound heals; and once his wound heals, he may retaliate.
