حَدَّثَنَا وَكِيعٌ حَدَّثَنَا سُفْيَانُ عَنْ أَبِي قَيْسٍ عَنِ الْهُزَيْلِ بْنِ شُرَحْبِيلٍ قَالَ جَاءَ رَجُلٌ إِلَى أَبِي مُوسَى وَسُلَيْمَانَ بْنِ رَبِيعَةَ فَسَأَلَهُمَا عَنْ ابْنَةٍ وَابْنَةِ ابْنٍ وَأُخْتٍ لِأَبٍ فَقَالَا لِلْبِنْتِ النِّصْفُ وَلِلْأُخْتِ النِّصْفُ وَأْتِ ابْنَ مَسْعُودٍ فَإِنَّهُ سَيُتَابِعُنَا قَالَ فَأَتَى ابْنَ مَسْعُودٍ فَسَأَلَهُ وَأَخْبَرَهُ بِمَا قَالَا فَقَالَ ابْنُ مَسْعُودٍ لَقَدْ ضَلَلْتُ إِذًا وَمَا أَنَا مِنْ الْمُهْتَدِينَ سَأَقْضِي بِمَا قَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لِلِابْنَةِ النِّصْفُ وَلِابْنَةِ الِابْنِ السُّدُسُ تَكْمِلَةَ الثُّلُثَيْنِ وَمَا بَقِيَ فَلِلْأُخْتِ.

Waki’ told us: Sufyan told us, from Abu Qays, from al-Huzayl ibn Shurahbil, who said: A man came to Abu Musa and Sulayman ibn Rabi’ah and asked them about the inheritance of a daughter, a son’s daughter, and a paternal sister. They said, "The daughter gets half, and the sister gets half; go to Ibn Mas’ud, for he will agree with us." He said: So he went to Ibn Mas’ud and asked him and told him what they had said. Ibn Mas’ud said, "Then I would indeed have gone astray and would not be among the rightly guided! I will judge according to what the Messenger of Allah, peace and blessings be upon him, judged: for the daughter, a half; for the son’s daughter, a sixth, completing the two-thirds; and what remains is for the sister."
