حَدَّثَنَا عَبْدُ الرَّزَّاقِ قَالَ أَخْبَرَنَا مَعْمَرٌ عَنِ الزُّهْرِيِّ عَنْ عُبَيْدِ اللَّهِ بْنِ عَبْدِ اللَّهِ أَنَّ أَبَا عَمْرِو بْنَ حَفْصِ بْنِ الْمُغِيرَةِ خَرَجَ مَعَ عَلِيِّ بْنِ أَبِي طَالِبٍ إِلَى الْيَمَنِ فَأَرْسَلَ إِلَى فَاطِمَةَ بِنْتِ قَيْسٍ بِتَطْلِيقَةٍ كَانَتْ بَقِيَتْ مِنْ طَلَاقِهَا وَأَمَرَ لَهَا الْحَارِثَ بْنَ هِشَامٍ وَعَيَّاشَ بْنَ أَبِي رَبِيعَةَ بِنَفَقَةٍ فَقَالَا لَهَا وَاللَّهِ مَا لَكِ مِنْ نَفَقَةٍ إِلَّا أَنْ تَكُونِي حَامِلًا فَأَتَتْ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَذَكَرَتْ ذَلِكَ لَهُ قَوْلَهُمَا فَقَالَ لَا إِلَّا أَنْ تَكُونِي حَامِلًا وَاسْتَأْذَنَتْهُ لِلِانْتِقَالِ فَأَذِنَ لَهَا فَقَالَتْ أَيْنَ تَرَى يَا رَسُولَ اللَّهِ قَالَ إِلَى ابْنِ أُمِّ مَكْتُومٍ وَكَانَ أَعْمَى تَضَعُ ثِيَابَهَا عِنْدَهُ وَلَا يَرَاهَا فَلَمَّا مَضَتْ عِدَّتُهَا أَنْكَحَهَا النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أُسَامَةَ بْنَ زَيْدٍ فَأَرْسَلَ إِلَيْهَا مَرْوَانُ قَبِيصَةَ بْنَ ذُؤَيْبٍ يَسْأَلُهَا عَنْ هَذَا الْحَدِيثِ فَحَدَّثَتْهُ بِهِ فَقَالَ مَرْوَانُ لَمْ نَسْمَعْ بِهَذَا الْحَدِيثِ إِلَّا مِنْ امْرَأَةٍ سَنَأْخُذُ بِالْعِصْمَةِ الَّتِي وَجَدْنَا النَّاسَ عَلَيْهَا فَقَالَتْ فَاطِمَةُ حِينَ بَلَغَهَا قَوْلُ مَرْوَانَ بَيْنِي وَبَيْنَكُمْ الْقُرْآنُ قَالَ اللَّهُ عَزَّ وَجَلَّ { لَا تُخْرِجُوهُنَّ مِنْ بُيُوتِهِنَّ وَلَا يَخْرُجْنَ إِلَّا أَنْ يَأْتِينَ بِفَاحِشَةٍ حَتَّى بَلَغَ لَعَلَّ اللَّهَ يُحْدِثُ بَعْدَ ذَلِكَ أَمْرًا } قَالَتْ هَذَا لِمَنْ كَانَ لَهُ مُرَاجَعَةٌ فَأَيُّ أَمْرٍ يُحْدِثُ بَعْدَ الثَّلَاثِ.

Abd al-Razzaq told us, he said Ma'mar informed us, from al-Zuhri, from Ubaydullah ibn Abdullah, that Abu Amr ibn Hafs ibn al-Mughirah went out with Ali ibn Abi Talib to Yemen, and he sent to Fatimah bint Qays a divorce that remained of her divorce, and he instructed al-Harith ibn Hisham and Ayyash ibn Abi Rabi'ah to give her maintenance, but they said to her, "By Allah, you have no maintenance unless you are pregnant." So she came to the Prophet, peace and blessings be upon him, and mentioned to him what they had said, and he said, "No, unless you are pregnant," and she asked his permission to move, and he permitted her. She said, "Where do you advise, O Messenger of Allah?" He said, "To Ibn Umm Maktum's" - and he was blind - "you may put off your clothes in his presence and he will not see you." When her waiting period had passed, the Prophet, peace and blessings be upon him, married her to Usamah ibn Zayd. Marwan sent Qabisah ibn Dhu'ayb to her to ask her about this hadith, and she narrated it to him. Marwan said, "We have not heard this hadith except from a woman; we will hold to the guardianship that we found the people upon." When Fatimah heard Marwan's statement, she said, "Between me and you is the Qur'an. Allah, Mighty and Majestic, says: {Do not turn them out of their houses, nor should they leave, except that they commit a clear immorality} up to His saying {Perhaps Allah will bring about after that a new situation}." She said, "This applies to one who has a right of return; so what new situation could occur after the third divorce?"
