حَدَّثَنَا مُحَمَّدُ بْنُ جَعْفَرٍ قَالَ حَدَّثَنَا شُعْبَةُ عَنْ مَنْصُورٍ قَالَ سَمِعْتُ مُجَاهِدًا يُحَدِّثُ عَنْ أُسَيْدِ بْنِ ظُهَيْرٍ قَالَ كَانَ أَحَدُنَا إِذَا اسْتَغْنَى عَنْ أَرْضِهِ أَوْ افْتَقَرَ إِلَيْهَا أَعْطَاهَا بِالنِّصْفِ وَالثُّلُثِ وَالرُّبُعِ وَيَشْتَرِطُ ثَلَاثَ جَدَاوِلَ وَالْقُصَارَةَ وَمَا سَقَى الرَّبِيعُ وَكُنَّا نَعْمَلُ فِيهَا عَمَلًا شَدِيدًا وَنُصِيبُ مِنْهَا مَنْفَعَةً فَأَتَانَا رَافِعُ بْنُ خَدِيجٍ فَقَالَ نَهَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنْ أَمْرٍ كَانَ لَكُمْ نَافِعًا وَطَاعَةُ اللَّهِ وَطَاعَةُ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ خَيْرٌ لَكُمْ نَهَاكُمْ عَنْ الْحَقْلِ وَقَالَ مَنْ كَانَتْ لَهُ أَرْضٌ فَلْيَمْنَحْهَا أَخَاهُ أَوْ لِيَدَعْهَا وَنَهَانَا عَنْ الْمُزَابَنَةِ وَالْمُزَابَنَةُ الرَّجُلُ يَكُونُ لَهُ الْمَالُ الْعَظِيمُ مِنْ النَّخْلِ فَيَجِيءُ الرَّجُلُ فَيَأْخُذُهَا بِكَذَا وَكَذَا وَسْقًا مِنْ تَمْرٍ.
انگریزی ترجمہ
Muhammad ibn Ja'far told us, saying: Shu'bah told us, from Mansur, who said: I heard Mujahid relate from Usayd ibn Zuhayr, who said: One of us, when he had no need of his land, or needed it, would give it out for a half, a third, or a quarter [of the produce], stipulating three water-channels, the residue, and whatever the stream irrigated, and we used to work it very hard and gain some benefit from it. Then Rafi' ibn Khadij came to us and said: "The Messenger of Allah, peace and blessings be upon him, has forbidden a matter that was beneficial to you, but obedience to Allah and obedience to the Messenger of Allah, peace and blessings be upon him, is better for you. He forbade you al-haql, and said: 'Whoever has land, let him lend it to his brother, or else leave it be.' And he forbade us al-muzabanah - and al-muzabanah is when a man has a great quantity of palm-produce, and another man comes and takes it for so-and-so many measures of dates."
