Hadrat Urwah ibn al-Zubayr (may Allah be well pleased with him) narrates that he asked Umm al-Mu'minin Hadrat Aisha al-Siddiqah (may Allah be well pleased with her) about the saying of Allah Most High: {And if you fear that you will not deal justly with orphan girls, then marry those that please you of other women.} She said: O nephew! This refers to the orphan girl who is in the care of her guardian and shares in his wealth. Her wealth and beauty attract him, so he wishes to marry her without being fair in her dowry — not giving her as much as others would give. So they were forbidden from marrying them unless they deal justly with them and give them the highest customary dowry. And they were commanded to marry other women who please them instead. Hadrat Urwah narrates: Hadrat Aisha (may Allah be well pleased with her) said: Then the people sought a ruling from the Beloved Messenger of Allah (blessings and peace of Allah be upon him) about these women after this verse. So Allah (Mighty and Majestic) revealed: {And they ask you for a ruling about women. Say: Allah gives you a ruling about them, and what is recited to you in the Book concerning orphan girls to whom you do not give what is prescribed for them while you desire to marry them.} She said: What Allah mentioned as being recited to them in the Book is the first verse in which Allah (Glorified and Exalted) said: {And if you fear that you will not deal justly with orphan girls, then marry those that please you of other women.} Hadrat Aisha (may Allah be well pleased with her) said: And the saying of Allah (Mighty and Majestic) in the latter verse — {while you desire to marry them} — refers to your reluctance toward the orphan girl in your care when she has little wealth and beauty. So they were forbidden from marrying the orphan women whose wealth and beauty they desired except with justice, on account of their reluctance toward those who lacked such qualities. Yunus said: Rabi'ah said regarding the saying of Allah (Mighty and Majestic) — {And if you fear that you will not deal justly with orphan girls}: Leave them if you fear (you cannot do justice), for He has made four (women) lawful for you.

حضرت عروہ بن حضرت زبیر رضی اللہ تعالیٰ عنہ فرماتے ہیں کہ انہوں نے حضرت اُمّ المؤمنین عائشہ صدیقہ رضی اللہ تعالیٰ عنہا سے اللہ تعالیٰ کے فرمان {وَإِنْ خِفْتُمْ أَنْ لَا تُقْسِطُوا فِي الْيَتَامَىٰ فَانْكِحُوا مَا طَابَ لَكُمْ مِنَ النِّسَاءِ} کے بارے میں پوچھا۔ انہوں نے فرمایا: اے میرے بھانجے! یہ وہ یتیم لڑکی ہے جو اپنے ولی کی پرورش میں ہو اور اس کے مال میں شریک ہو۔ ولی کو اس کا مال اور خوبصورتی اچھی لگے تو وہ اس سے نکاح کرنا چاہے بغیر اس کے مہر میں انصاف کیے، کہ اسے اتنا مہر نہ دے جتنا دوسرا اسے دیتا۔ تو منع کیا گیا کہ ان سے نکاح نہ کریں جب تک ان کے حق میں انصاف نہ کریں اور ان کے مہر کی اعلیٰ ترین رسم تک نہ پہنچائیں، اور حکم دیا گیا کہ ان کے سوا جو عورتیں اچھی لگیں ان سے نکاح کریں۔ حضرت عروہ فرماتے ہیں: حضرت اُمّ المؤمنین عائشہ رضی اللہ تعالیٰ عنہا نے فرمایا: پھر لوگوں نے اس آیت کے بعد ان عورتوں کے بارے میں رسول اللہ صلی اللہ تعالیٰ علیہ وآلہ وسلم سے فتویٰ پوچھا تو اللہ عزوجل نے یہ آیت نازل فرمائی: {وَيَسْتَفْتُونَكَ فِي النِّسَاءِ قُلِ اللَّهُ يُفْتِيكُمْ فِيهِنَّ وَمَا يُتْلَىٰ عَلَيْكُمْ فِي الْكِتَابِ فِي يَتَامَى النِّسَاءِ اللَّاتِي لَا تُؤْتُونَهُنَّ مَا كُتِبَ لَهُنَّ وَتَرْغَبُونَ أَنْ تَنْكِحُوهُنَّ}۔ فرمایا: جسے اللہ نے ذکر کیا کہ کتاب میں ان پر تلاوت کیا جاتا ہے وہ پہلی آیت ہے جس میں اللہ تعالیٰ نے فرمایا: {وَإِنْ خِفْتُمْ أَنْ لَا تُقْسِطُوا فِي الْيَتَامَىٰ فَانْكِحُوا مَا طَابَ لَكُمْ مِنَ النِّسَاءِ}۔ حضرت اُمّ المؤمنین عائشہ رضی اللہ تعالیٰ عنہا نے فرمایا: اور اللہ عزوجل کا دوسری آیت میں فرمان {وَتَرْغَبُونَ أَنْ تَنْكِحُوهُنَّ} یہ تمہاری اس یتیم لڑکی سے بے رغبتی ہے جو تمہاری پرورش میں ہے جب وہ مال اور خوبصورتی میں کم ہو۔ تو منع کیا گیا کہ یتیم عورتوں میں سے جن کے مال اور خوبصورتی کی رغبت ہو ان سے نکاح نہ کریں مگر انصاف کے ساتھ، ان سے بے رغبتی کی وجہ سے۔ یونس نے کہا: ربیعہ نے اللہ عزوجل کے فرمان {وَإِنْ خِفْتُمْ أَنْ لَا تُقْسِطُوا فِي الْيَتَامَىٰ} کے بارے میں فرمایا: اگر ڈرو (کہ یتیموں میں انصاف نہ کر سکو گے) تو انہیں چھوڑ دو، بلاشبہ (اللہ نے) تمہارے لیے چار (عورتیں) حلال کر دی ہیں۔
