قَالَ قُلْتُ لِقُتَيْبَةَ بْنِ سَعِيدٍ حَدَّثَكُمْ مُحَمَّدُ بْنُ يَحْيَى بْنِ قَيْسٍ الْمَأْرِبِيُّ حَدَّثَنِي أَبِي عَنْ ثُمَامَةَ بْنِ شَرَاحِيلَ عَنْ سُمَيِّ بْنِ قَيْسٍ عَنْ سُمَيْرٍ عَنْ أَبْيَضَ بْنِ حَمَّالٍ أَنَّهُ وَفَدَ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَاسْتَقْطَعَهُ الْمِلْحَ فَقَطَعَ لَهُ فَلَمَّا أَنْ وَلَّى قَالَ رَجُلٌ مِنْ الْمَجْلِسِ أَتَدْرِي مَا قَطَعْتَ لَهُ إِنَّمَا قَطَعْتَ لَهُ الْمَاءَ الْعِدَّ قَالَ فَانْتَزَعَهُ مِنْهُ قَالَ وَسَأَلَهُ عَمَّا يُحْمَى مِنْ الْأَرَاكِ قَالَ مَا لَمْ تَنَلْهُ خِفَافُ الْإِبِلِ فَأَقَرَّ بِهِ قُتَيْبَةُ وَقَالَ نَعَمْ حَدَّثَنَا مُحَمَّدُ بْنُ يَحْيَى بْنِ أَبِي عُمَرَ حَدَّثَنَا مُحَمَّدُ بْنُ يَحْيَى بْنِ قَيْسٍ الْمَأْرِبِيُّ بِهَذَا الْإِسْنَادِ نَحْوَهُ الْمَأْرِبُ نَاحِيَةٌ مِنْ الْيَمَنِ قَالَ وَفِي الْبَاب عَنْ وَائِلٍ وَأَسْمَاءَ بِنْتِ أَبِي بَكْرٍ قَالَ أَبُو عِيسَى حَدِيثُ أَبْيَضَ حَدِيثٌ غَرِيبٌ وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَغَيْرِهِمْ فِي الْقَطَائِعِ يَرَوْنَ جَائِزًا أَنْ يُقْطِعَ الْإِمَامُ لِمَنْ رَأَى ذَلِكَ.
English Translation
He said: I said to Qutaibah bin Sa'id: Muhammad bin Yahya bin Qais Al-Ma'ribi narrated to you saying: My father narrated to me from Thumamah bin Sharahil from Sumayy bin Qais from Sumair from Hadrat Abyad bin Hammal (may Allah be well pleased with him) that he came as a delegate to the Beloved Messenger of Allah (blessings and peace of Allah be upon him) and asked him for a salt mine, so he granted it to him. When he turned away, a man from the gathering said: Do you know what you have granted him? You have granted him abundant water (i.e., a perpetual source). So he took it back from him. And he asked the Noble Prophet (blessings and peace of Allah be upon him) about protecting Arak trees, and he stated: What the hooves of the camels cannot reach (may be protected). Qutaibah confirmed this and said: Yes. Muhammad bin Yahya bin Abi Umar narrated from Muhammad bin Yahya bin Qais Al-Ma'ribi with this chain of narration something similar. Al-Ma'rib is a region of Yemen. In this chapter there are also narrations from Hadrat Wa'il and Hadrat Asma bint Abi Bakr (may Allah be well pleased with them). Abu Isa said: The hadith of Abyad is Gharib. The people of knowledge act upon this regarding land grants -- they consider it permissible for the leader to grant land to whoever he sees fit.
Urdu Translation
حضرت ابوہریرہ رضی اللہ تعالیٰ عنہ فرماتے ہیں کہ رسول اللہ صلی اللہ تعالیٰ علیہ وآلہ وسلم نے پانچ وسق سے کم میں عرایا کے بیچنے کی اجازت دی ہے یا ایسے ہی کچھ آپ نے فرمایا۔ راوی کو شک ہے کہ حدیث کے یہی الفاظ ہیں یا کچھ فرق ہے۔ امام ترمذی فرماتے ہیں: حضرت ابوہریرہ رضی اللہ تعالیٰ عنہ کی حدیث حسن صحیح ہے۔
