Arabic (Original)
أَخْبَرَنَا مُحَمَّدُ بْنُ قُدَامَةَ، قَالَ حَدَّثَنَا جَرِيرٌ، عَنْ مَنْصُورٍ، عَنْ إِبْرَاهِيمَ، عَنْ عُبَيْدِ بْنِ نُضَيْلَةَ الْخُزَاعِيِّ، عَنِ الْمُغِيرَةِ بْنِ شُعْبَةَ، قَالَ ضَرَبَتِ امْرَأَةٌ ضَرَّتَهَا بِعَمُودِ الْفُسْطَاطِ وَهِيَ حُبْلَى فَقَتَلَتْهَا فَجَعَلَ رَسُولُ اللَّهِ صلى الله عليه وسلم دِيَةَ الْمَقْتُولَةِ عَلَى عَصَبَةِ الْقَاتِلَةِ وَغُرَّةً لِمَا فِي بَطْنِهَا . فَقَالَ رَجُلٌ مِنْ عَصَبَةِ الْقَاتِلَةِ أَنَغْرَمُ دِيَةَ مَنْ لاَ أَكَلْ وَلاَ شَرِبَ وَلاَ اسْتَهَلّ فَمِثْلُ ذَلِكَ يُطَلّ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم " أَسَجْعٌ كَسَجْعِ الأَعْرَابِ " . فَجَعَلَ عَلَيْهِمُ الدِّيَةَ .
English Translation
It is narrated that Hadrat Al-Mughirah bin Shu'bah (may Allah be well pleased with him) said: "A woman struck her co-wife, who was pregnant, with a tent pole and Killed her, The Beloved Messenger of Allah (blessings and peace of Allah be upon him) ruled that the 'Asahab of the Killer was to pay the Diyah and to give a slave (as Diyah for ) the child in her womb. One of the'Asabah of the killer said: 'Am I to pay blood money for one whom neither ate nor drank, or shouted or cried (at the moment of birth)? Such a one should be overlooked. The Beloved Messenger of Allah (blessings and peace of Allah be upon him) said: 'Rhyming verse like the verse of the Bedouin?' and he made them pay the Diyah
Urdu Translation
حضرت مغیرہ بن شعبہ رضی اللہ تعالیٰ عنہ فرماتے ہیں کہ ایک عورت نے اپنی سوتن کو خیمے کے ستون سے مارا اور وہ حاملہ تھی، اسے قتل کر دیا۔ رسول اللہ صلی اللہ تعالیٰ علیہ وآلہ وسلم نے مقتولہ کی دیت قاتلہ کے عصبہ پر مقرر فرمائی اور اس کے پیٹ کے بچے کے لیے غُرّہ (ایک غلام یا لونڈی) مقرر فرمایا۔ قاتلہ کے عصبہ میں سے ایک شخص نے کہا: ہم اس کی دیت دیں جس نے نہ کھایا، نہ پیا، نہ چلایا، ایسے کا خون رائیگاں ہے۔ رسول اللہ صلی اللہ تعالیٰ علیہ وآلہ وسلم نے ارشاد فرمایا: کیا یہ اعرابیوں کی طرح مسجع بات ہے؟ پس آپ نے ان پر دیت مقرر فرمائی۔
