حَدَّثَنَاعَبْدُ اللَّهِ بْنُ هَاشِمٍ، قَالَ: ثنايَحْيَى يَعْنِي الْقَطَّانَ، عَنْعَبْدِ الْمَلِكِ بْنِ أَبِي سُلَيْمَانَ، قَالَ: سَمِعْتُسَعِيدَ بْنَ جُبَيْرٍ، يَقُولُ:" سُئِلَتْ عَنِ الْمُتَلاعِنَيْنِ، أتُفَرَّقُ بَيْنَهُمَا فِي إِمَارَةِ ابْنِ الزُّبَيْرِ رَضِيَ اللَّهُ عَنْهُمَا؟ فَمَا دَرَيْتُ مَا أَقُولُ، فَقُمْتُ مَكَانِي إِلَى مَنْزِلِ ابْنِ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا، فَقُلْتُ:أَبَا عَبْدِ الرَّحْمَنِ، الْمُتَلاعِنَانِ أَيُفَرَّقُ بَيْنَهُمَا؟ قَالَ: سُبْحَانَ اللَّهِ، نَعَمْ، إِنَّ أَوَّلَ مَنْ سَأَلَ عَنْ ذَلِكَ فُلانُ بْنُ فُلانٍ، قَالَ: يَا رَسُولَ اللَّهِ،" أَرَأَيْتَ الرَّجُلَ مِنَّا يَرَى امْرَأَتَهُ عَلَى فَاحِشَةٍ، إِنْ تَكَلَّمَ تَكَلَّمَ بِأَمْرٍ عَظِيمٍ، وَإِنْ سَكَتَ سَكَتَ عَلَى مثل ذَلِكَ، قَالَ: فَلَمْ يُجِبْهُ، قَالَ: فَلَمَّا كَانَ مِنَ الْغَدِ أَتَاهُ، فَقَالَ: الَّذِي سَأَلْتُ عَنْهُ قَدِ ابْتُلِيتُ بِهِ، فَأَنْزَلَ اللَّهُ هَذِهِ الآيَةَ فِي سُورَةِ النُّورِ: وَالَّذِينَ يَرْمُونَ أَزْوَاجَهُمْ حَتَّى بَلَغَ: وَالْخَامِسَةَ أَنَّ غَضَبَ اللَّهِ عَلَيْهَا إِنْ كَانَ مِنَ الصَّادِقِينَ سورة النور آية 6 - 9 فَبَدَأَ بِالرَّجُلِفَوَعَظَهُ وَذَكَّرَهُ، وَأَخْبَرَهُ أَنَّ عَذَابَ الدُّنْيَا أَهْوَنُ مِنْ عَذَابِ الآخِرَةِ، فَقَالَ: وَالَّذِي بَعَثَكَ بِالْحَقِّ مَا كَذَبْتُ، ثُمَّ ثَنَّى بِالْمَرْأَةِ فَوَعَظَهَا وَذَكَّرَهَا، وَأَخْبَرَهَا أَنَّ عَذَابَ الدُّنْيَا أَهْوَنُ مِنْ عَذَابِ الآخِرَةِ، فَقَالَتْ: وَالَّذِي بَعَثَكَ بِالْحَقِّ إِنَّهُ لَكَاذِبٌ، قَالَ: فَبَدَأَ بِالرَّجُلِ فَتَشَهَّدَ أَرْبَعَ شَهَادَاتٍ بِاللَّهِ إِنَّهُ لِمَنَ الصَّادِقِينَ، وَالْخَامِسَةَ أَنَّ لَعْنَةَ اللَّهِ عَلَيْهِ إِنْ كَانَ مِنَ الْكَاذِبِينَ، ثُمَّ ثَنَّى بِالْمَرْأَةِ فَشَهِدَتْ أَرْبَعَ شَهَادَاتٍ بِاللَّهِ إِنَّهُ لِمَنَ الْكَاذِبِينَ، وَالْخَامِسَةَ أَنَّ غَضَبَ اللَّهِ عَلَيْهَا إِنْ كَانَ مِنَ الصَّادِقِينَ، ثُمَّ فَرَّقَ بَيْنَهُمَا".
English Translation
Sa'id ibn Jubayr said: I was asked about the couple who performed li'an — should they be separated during the governorship of Ibn al-Zubayr (may Allah be pleased with them both)? I did not know what to say, so I went to the house of Ibn Umar (may Allah be pleased with them both) and said: O Abu Abd al-Rahman, should the couple who performed li'an be separated? He said: Subhan Allah! Yes indeed. The first to ask about that was so-and-so, who said: O Messenger of Allah, what do you say about a man among us who sees his wife committing adultery? If he speaks, he speaks about a tremendous matter; if he stays silent, he stays silent about something similar. He said: The Prophet (peace and blessings of Allah be upon him) did not answer him. The next day, the man came and said: What I asked you about has befallen me. So Allah revealed these verses in Surah al-Nur: 'And those who accuse their wives...' until '...and the fifth that the wrath of Allah be upon her if he is among the truthful' [al-Nur 24:6-9]. He began with the man, admonishing him and reminding him, and told him that the punishment of this world is lighter than the punishment of the Hereafter. He said: By the One who sent you with the truth, I have not lied. Then he turned to the woman, admonishing her and reminding her, and told her that the punishment of this world is lighter than the punishment of the Hereafter. She said: By the One who sent you with the truth, he is a liar. He began with the man, who bore witness four times by Allah that he was truthful, and the fifth time invoked the curse of Allah upon himself if he was lying. Then the woman bore witness four times by Allah that he was lying, and the fifth time invoked the wrath of Allah upon herself if he was truthful. Then he separated them.
Urdu Translation
سعید بن جبیر رحمہ اللہ کہتے ہیں کہ سیدنا عبد اللہ بن زبیر رضی اللہ عنہما کی خلافت کے دور میں مجھ سے متلاعنین (خاوند بیوی) کے متعلق پوچھا گیا: کیا ان کے درمیان جدائی کرا دی جائے گی؟ مجھے علم نہیں تھا کہ میں کیا جواب دوں، چنانچہ میں اپنے گھر سے اٹھا اور سیدنا عبد اللہ بن عمر رضی اللہ عنہما کے گھر چلا گیا، میں نے پوچھا: ابو عبد الرحمن! کیا متلاعنین (خاوند بیوی) کے درمیان جدائی ڈال دی جائے گی؟ انہوں نے کہا: سبحان اللہ! جی ہاں! سب سے پہلے اس بارے میں فلاں بن فلاں نے پوچھا تھا، اس نے کہا: اللہ کے رسول! مجھے بتائیں کہ کوئی آدمی اپنی بیوی کو بدکاری کرتے ہوئے دیکھ لے تو کیا کرے؟ اگر بات کرتا ہے، تو بہت بڑی بات ہے، اگر چپ کرتا ہے، تو پھر بھی ایسے ہی ہے۔ آپصلی اللہ علیہ وسلمنے اسے کوئی جواب نہ دیا، اگلے دن وہ آدمی آکر کہنے لگا: جو بات میں نے آپ سے پوچھی تھی، میں اس میں مبتلا ہو چکا ہوں۔ تو اللہ تعالیٰ نے سورہ نور کی یہ آیت اتاری:﴿وَالَّذِينَ يَرْمُونَ أَزْوَاجَهُمْ........ وَالْخَامِسَةَ أَنَّ غَضَبَ اللهِ عَلَيْهَا إِنْ كَانَ مِنَ الصَّادِقِينَ﴾(النور: 6[المنتقى ابن الجارود/كتاب الطلاق/حدیث: 752]
