أَخْبَرَنَا مُحَمَّدُ بْنُ إِسْحَاقَ بْنِ خُزَيْمَةَ قَالَ حَدَّثَنَا مُحَمَّدُ بْنُ الْمُثَنَّى قَالَ حَدَّثَنَا عَبْدُ الرَّحْمَنِ بْنُ مَهْدِيِّ عَنْ سُفْيَانَ عَنْ فِرَاسٍ عَنِ الشَّعْبِيِّ عَنْ مَسْرُوقٍ عَنْ عَبْدِ اللَّهِ فِي رَجُلٍ تَزَوَّجَ وَلَمْ يَدْخُلْ بِهَا وَلَمْ يَفْرِضْ فَقَالَ لَهَا الصَّدَاقُ كَامِلًا وَعَلَيْهَا الْعِدَّةُ وَلَهَا الْمِيرَاثُ قَالَ مَعْقِلُ بْنُ سِنَانٍ «شَهِدْتُ رَسُولَ اللَّهِ ﷺ قَضَى بِهِ فِي بِرْوَعَ بِنْتِ وَاشِقٍ»
English Translation
Hadrat Abdullah ibn Mas'ud (may Allah be well pleased with him) was asked about a man who married a woman but did not consummate the marriage and did not specify a dowry, and the husband died. He said: "She is entitled to the full dowry, she must observe the waiting period, and she receives the inheritance." Hadrat Ma'qil ibn Sinan (may Allah be well pleased with him) said: "I witnessed the Beloved Messenger of Allah (blessings and peace of Allah be upon him) give the same ruling regarding Birwa' bint Washiq."
Urdu Translation
حضرت عبداللہ بن مسعود رضی اللہ تعالیٰ عنہ سے ایک ایسے آدمی کے بارے میں پوچھا گیا جس نے عورت سے نکاح کیا لیکن نہ رخصتی ہوئی اور نہ مہر مقرر کیا، اور شوہر فوت ہو گیا۔ انہوں نے فرمایا: اس کے لیے پورا مہر ہے، اس پر عدت واجب ہے، اور اسے میراث ملے گی۔ حضرت معقل بن سنان رضی اللہ تعالیٰ عنہ نے فرمایا: میں نے رسول اللہ صلی اللہ تعالیٰ علیہ وآلہ وسلم کو بروع بنت واشق کے بارے میں یہی فیصلہ فرماتے دیکھا۔
